41. JAMES4 MCBRAYER (WILLIAM3, JAMES2, FATHER '1ST GEN'1) was born May 08, 1787 in Anderson Co., KY, and died January 14, 1855 in Lawrenceburg, Anderson Co., KY. He married (1) ELIZABETH WHITE August 21, 1816 in KY, daughter of PHILIP WHITE and LUCY MILLS. She was born Bet. 1788 - 179141, and died June 26, 1833 in Lawrenceburg, Anderson Co., KY. He married (2) MARTHA BOND November 29, 1849 in Frankfort, KY42, daughter of THOMAS M. BOND. She was born 1810 in MD, and died June 13, 1854 in KY.

Both James and Martha are buried in the Elliott-McBrayer cemetery.

The following is an extract copy of the marriage bond between James and Elizabeth White Clark (from the files of Dee Merritt).

KNOW ALL MEN BY THE PRESENTS, that we JAMES MCBRAYER and JOHN B. RAPELLEA (? spelling) are held and firmly bound unto the Commonwealth of Kentucky in the sum of 100 pounds to the payment whereof well and truly to be made, we bind ourselves, our heirs, etc., jointly and severally, firmly by these presents. Sealed with our seals, and dated this 21st day of August 1816.

The condition of the above obligation is such, that whereas a marriage is shortly intended to (be) solemnized between the above bound James McBrayer, Jr., and Betsy Clarke, Daughter of Philip White of this county: Now, shall it always hereafter appear, that there is no just cause to obstruct the said marriage, then the above obligation to be void, else to remain in full force and virtue.

James was a Representative from Franklin Co., KY in the Legislature of 1824 - was elected Sheriff of Anderson Co., KY 1831-1833 - also held the position of Collector of Revenues.

LIZABETH WHITE:
It is said that Elizabeth White Clark McBrayer died in KY of cholera on 26 Jun 1833, however, she is not listed in the 1830 census of Anderson Co. She is buried in the Elliott-McBrayer Cem. on what is now the John Redman farm on the north side of the Lawrenceburg and Glenboro road near Lawrenceburg, KY. Her headstone is of native stone - dates are unreadable. (data from Harvey S. McBrayer.)

  Notes for JOHN M. MCBRAYER:
He never married. He settled in Lawrenceburg, KY, and during the Mexican War, he served as a Lt. with the fighting "Salt River Tigers". He later studied law under JUDGE THOMAS B. MONROE at Frankfort, KY. In 1849 he moved to California and after his health failed he moved to Hawaii. He died 13 Dec 1856 at the age of 31 years and is buried in the old Elliott-McBrayer Cemetery near Lawrenceburg, KY. He was a lawyer and a member of the KY Legislature. *McBrayer Genealogy-1926.

John served as a Democrate in the California State Assembly, 9th District, 1854-1855. He was living in Sacremento Co. at the time. (Internet information - Dec 2001)

APTAIN WILLIAM H. MCBRAYER:
Some researchers say he was dead prior to 4 Nov 1830, as only Polly, his wife, is listed in the 1850 census reports (Jessamine Co., KY). (She and Frances M. McBrayer were listed as living with Doctor John Welch, her son-in-law.) It is reported that William and Polly were divorced prior to 4 Nov 1830 (according to "McBrayer Genealogy" 1926). Another source, THE HUME FAMILY, pg 174, also states they were divorced before 4 Nov, 1830.

ANFORD MCBRAYER:
He died when the steamer "War Eagle" burned on the Mississippi River near La Cross, WI, on 15 May 1870.

The 1850 census of Mercer Co., KY, lists him as a merchant in Harrodsburg, Dist #2.

"When a very young man, Sanford was a deputy sheriff and deputy surveyor of Anderson Co. He later became a merchant and banker. He was President of the Commercial bank at Harrodsburg, KY, at the time of his death. He was a man of high standing in his community." (McBrayer Genealogy - 1926)
