McGibboney (McGibney), _______, Lieutenant. Fourth North Carolina Regiment. Embezzling and misapplying the money with which he was entrusted for enlisting men into the service, and taking bribes to discharge enlisted men from the service: acquitted.

Crimes: Fraud and Embezzlement
       "Officers were charged with the responsibility of enlisting recruits and were furnished with public money for that purpose. It was wometimes possible for an officer to report a hypothetical enlistment, falsely carry a name on his monthly returns, and pocket the money himself. In a few instances, a man could be recruited and then immediately assigned as a laborer at either the officer's own farm or that of a friend, while being reported present in camp. Officers placed in charge of army supplies were especially vulnerable to the temptation of embezzlement of goods in their possession...
        A highly coveted discharge from the army was worth paying for if a soldier had the means to buy it from an unscrupulous officer with the authority to issue one. Such an officer, knowing that the soldier might well desert anyway, could figure to profit from the man's decision to go home regardless..."



WILL OF PATRICK MCGIBBONEY

       In the name of God Amen ---- whereas Patrick McGibboney of the County of Guilford and State of North Carolina well knowing the uncertainty of life and certainty of death and being weak in body but of sound mind and memory do think proper to have the following lines as my last will and testament principally and first of all I recommend my soul to God who gave it and my body to the earth to be buried in a decent Christian like manner at the discretion of my Executors hereafter named --- and as touching what worldly substances it has pleased God to Bless me with it is my will to dispose of in the following manner: First -- it is my will that all my just debts be paid in a reasonable time. 2ndly --- I give and bequeath to my son David McGibboney one negro boy named Jim and first choice of all my horse beasts and if it shall be a mare that has a colt under one year old it shall to with the mare --- And my bed and furniture and all my wearing apparel and all my riding furniture of whatever mane or nature, one cow and calf, four sheep, one sow and six pigs or shoats, two sets of horse gear and as much utensils as will be sufficient to carry on the farm to be laid off by John Cunningham and Wm. Aunfield ye -------- . The waggon excepted and all the lands I possess on the waters of South Buffaloe and one fourth part of the grain that may be on the plantation at my decease.
       3rdly ---- I give and bequeath to my daughter Margret Gillespie two dollars and one half to by her own use and ----- and the interest of one hundred pounds hard money to by put at interest by my Exrs. and paid to her annually but if my Exrs. should see that her husband is so informed that he is likely to do well for himself and family so as to maintain them in a genteel manner then and in that case it shall be in their discression to give her the principal at the time they may think fit if otherwise let her have the interest during her life and at her death the first child she has male or female that has dark hair shall heir the sd. Hund. pounds.
       4thly ---- I give and bequeath to my daughter Isbel McGiboney my negroe girl named Hannah and her saddle.
       5thly ---- I give and bequeath to my daughter Martha McGiboney one bond on Wid. Mills gr. Hamilton Hance McCain and ________ Matheny in lieu of a negroe.
       6thly --- I give and bequeath to my daughter Jean McGiboney my negroe boy named Bob.
       7thly --- I give and bequeath to my friend Col Daniel Gillaspie the use of one negroe boy named Isaac during his natural life and at his death if the County Court of Guilford should deem him to be worthy of freedom to be set free and if otherwise to be sold and the price to be equally divided between my four youngest children.
       8thly ---- I give and bequeath to my four youngest children and my daughter Margret Gillaspies second child that may have brown hair all the land I possess in the Tennessee State to be equally divided between them agreeable to quantity and quality and if she has no child of that description viz brown or dark hair then and in that case the above mentioned hundred pounds and the fifth of the above mentioned land to be equally divided among my four youngest children.
       9thly ---- And all the rest of my estate real and personal to be sold and equally divided between my three daughters namely Isbel McGiboney, Martha McGiboney and Jean McGiboney except such part of my household furniture as my three youngest dauters chose to have valued to them by my Executors hereafter named and my negroe girl named Patience excepted --- also I leave in the care of my trusty friend John Cunningham untill she arrives at the age of fourteen years which is left in his discression to let my daughter Margret Gillaspie have her at any time he may think advisable by taking bond and sufficient securtiy for returning her when called for if ever she is demanded but if her husband should conduct in a manner likely to do so well as to maintain his family in a genteel manner then sd negroe to remain in the possession of her and her heirs forever --- if not to be sold and the price put to interest and the interest of that and the aforementioned hundred pounds to be put to the use annually for such things as she may stand in need of to be purchased by my Executors...





Patrick McGibboney was a leader and a prosperous farmer. He was appointed foreman of the Grand Jury in Surry County on 14 February 1786 when he had lived in the area less than two years and again on 13 November 1787. The grand jury heard criminal cases. He was given permission to build a frist mill on his property on Belews Creek on 15 February 1788, a fact that indicates he was of an enterprising nature; the permission was rescinded on 15 May 1788, the mill "being within distance prohibitted by law of Henry Hmpton's Mill, which from now on will be deemed a publick mill." He served on the Surry County Grand Jury in 1788 and was again appointed to a road crew in February 1789...
