The first record that has so far been located is Willis' own account of his service in the War of 1812, recorded in his application for pension under the Act of February 14, 1871. Willis volunteered in Captain William White's Company of Tennessee Militia, at a muster ground in Roane County, at a man's residence by the name of Charles White around the 20th of September 1813. Toward the end of September, the Company met in Kingston, organized itself and left for the seat of war in the Creek Nation. The regiment was commanded by Col. John Brown, and was composed of both infantry and mounted riflemen in which Willis served as a private. He believed the brigade was commanded by Gen'l white. During the time of his enlistment, the company encamped at Richland in Rhea County, Tennessee for a week or two, and an additional week or two at Ross Landing. November 20, 1818, Willis married Nancy Kendrick, born May 25, 1800, daughter of Samuel and Margaret Kendrick (these are my husband's ancestors). It is at at this time that Willis' name appears on the tax records of Roane County, owning 17 town lots in 1821 and up to 530 acres in 1840. The Act of Congress of March 3, 1855, awarded Willis 160 acres for which he received a warrant. From Nancy Short's application for a widow's pension, it is learned that Willis was of Irish descent, born in South Carolina, 17 years old at the time he volunteered, height about six feet, hair reddish, eyes blue and complexion fair, whose occupation was that of Farmer. Over the years Willis and Nancy had 14 children, all born in Roane County, TN. At least 6 of the children migrated to the State of Missouri, 1 to Arkansas, 1 may have joined other family members in North Carolina and two enlisted together and died together in the Civil War. Another died of eating wild parsnip when he was looking for ginseng, and another may have migrated to Kentucky. Willis died May 22, 1879; Nancy, July 6, 1885, and both are interred in the Kendrick Cemetary. Their farm at Hood's Landing is now mostly submerged by the waters of the Watts Bar Dam. OWINGS, merchant and manufacturer of woolen goods, was born December 15, 1815, within three miles of Rockwood, his present home, where he has since lived, excepting two years in Kentucky and Ohio. When eighteen he was thrown on his own resources, and by his own ability has acquired what he has. He was a carpenter and millwright before the war, when he was made sutler by Col. BYRD, of the First Tennessee, in which he continued up to 1863. He then engaged in merchandising at Nicholasville, Ky., where he remained one year, and then returned to Roane County, his present home. On January 13, 1839, he married Margaret, a daughter of Samuel and Margaret KENDRICK, who were the earliest pioneers of Roane County, and of German descent. Of our subject's eight children, the following are now living: Samuel A., F.D., State's attorney of the Roane County District; Mary, now Mrs. William SMITH; and Martha A., now Mrs. Thomas A. BROWN. He and his wife are members of the Christian Church. He is a Republican, and first voted for VAN BUREN. He is the eldest of thirteen children born to Samuel and Sarah (RANDOLPH) OWINGS. The father was born and reared in Roane County, and was a soldier in the war of 1812, and assisted in the removal of the Cherokee Indians to the Indian Territory. He was the third of nine children born to Edward and Elizabeth (SUMPTER) OWINGS, natives of North Carolina, and he was the first man to cross the Big Emory River and there build a house. Both were of English descent, and the grand-mother was a woman of remarkable force of character. THE OWINGS FAMILY SUBMITTED BY HELEN OWINGS ROHRER The Owings family came to America from England. The first records in this country are found in Burke County, North Carolina, where Edward Owings married Elizabeth Sumpter, daughter of William Sumpter, a captain in the American Revolution. Their wedding took place in 1789 and nine children were born to them. One son in this family, Samuel Sumpter Owings, married Sarah Randolph in 1814 and they made their home in Roane County, Tennessee, at Post Oak Springs. There were thirteen children born to this union, nine girls and four boys. The Owings have always been musical and lovers of music. A story that bears this out is about Samuel S. Owings who trained a chorus made up of all his children. On occasion when he came home late at night (after a nip or two too many) he would arouse the children and make them sing. The sweet voices often lulled him to sleep and when he dozed, some of the sleepy children tried to slip away, to go back to bed. But if the music died down, he would awaken and make them sing more. One of the most colorful Owings ancestors was William Jackson Owings, one of the above mentioned singing group. He was married to Margaret Kindrick in 1839. He preached in the Post Oak Springs Christian Church in the 1850's and was also an excellent business man. He had a foundry were cast iron articles were made, including kitchen ware, such as hoe-cake bakers, spiders, boiling pots and Dutch ovens, some of which are still used by his descendants. He had also a furniture factory and a woolen mill at various times. During the Civil War years, W. J. Owings was in Kentucky where he accumulated a fortune in the mercantile business. He returned to Post Oak Springs at the War's end. It was W. J. Owings' belief that community life as described in the book of Acts where Christians "had all things in common", should be restored. He and his followers broke away from the Post Oak Church and he put his beliefs into practice. OWINGS BIOGRAPHIES INDEX A Prominent Attorney Who Stands at the Head of His Profession in Roane County. Of the young sons of East Tennessee, Gen. F.D. OWINGS, of Rockwood, stands in the forefront. He was born December 15th, 1852, receiving his first lessons in the common schools under the tutorship of Col. Jno. R. NEAL. From the common schools he spent one year at Emory and Henry college, at the end of which his school days ceased for a time. In 1880 Mr. OWINGS was elected to represent Roane County in the state legislature where he made quite a name for himself, and to the prominence here attained he has never ceased to add to through energy, courage, close application and a determination to climb higher. In 1882 at the termination of his legislative term, he received an appointment from Washington in one of the departments there, and while in Washington, in 1885, graduated in the law department of the National University. Returning to Roane County, he was elected state's attorney-general in 1886. That he filled this position acceptibly (sic) none will deny, since he was re-elected in '94 without opposition from any political party. Gen. OWINGS has a splendid personal appearance, being very portly, and is second to no prosecuting attorney in the state. In addition he is a devout republican, always ready to engage in battle for his party and party principles. In this respect, if it is possible to be, he is a greater power than as an attorney, and it would be truth to say that there is not a stump speaker in Tennessee with greater ability or magnetism, coupled with power, admiring friends all over the Second congressional district are calling upon him as a favorite son for congressional honors, believing that he can more truly and wisely represent the common interests of all than the present incumbent. Whether the general makes the race, whether he continues in his present position, he will be found active and zealous in court and in field, with aspirations pointing him onward and upward. Ed ROBERTS were very much surprised at the wedding which took place at six o'clock Monday morning at Oak Circle, the pretty surburban home of the bride; the happy couple leaving on the six-thirty train for her future home, Enid, Oklahoma. Capt. ROBERTS has been a resident of Oklahoma for several years and holds a responsible and very lucrative position with the Denver and Enid Gulf Railroad Co. He is a thoroughly honorable, capable young man and no doubt will make his mark in the business world. He is the only son of Mr. and MRs. I.A. ROBERTS, who randk among Rockwood's most substantial and highly respected citizens. Miss Olive OWINGS is well known as one of Roane county's most beautiful young ladies, possessing a charming personality, and numbers her friends only by her acquaintances. She is the youngest daughter of General F.D. OWINGS, and comes of one of the oldest and best familes of East Tennessee. The marriage ceremony was pronounced by the Rev. A.A. FERGUSON, pastor of the Christian church, of which Miss OWINGS is a devoted member, she was also one of the most popular members of the Monday Club and Smart Set, a church and social organization. THe bride was unusally handsome attired in a dark blue silk coat suit(?) white embroidered waist, and a chic little blue milan straw continental hat. In spite of the early morning hour and secrecy of the wedding quite a number of friends were at the station to bestow an abundance of congratulations, good wishes and rice on the happy and popular couple, whom we regret very much to lose as residents of our city, but wish for them a long, happy and prosperous life. 45. iii. Insurance of a Rockwood Soldier killed in action in 1942 can be withheld by the Veterans Administration under a 1946 ruling is an issue Judge Robert L. Taylor, new Federal Judge, must decide in a case set for Jan. 24th. Amount of the insurance is $5000 and the policy was sworn out by Cpl. Casper W. Hinds when he entered service in 1942, and listed Mrs. Lula Hickey Thomas as next of kin. Hinds was killed while serving with the Army in the Mediterranean late in 1942. When at first he was reported missing in action, Mrs. Thomas got the official notification, and the Army sent her the soldier's gratuity pay for six months of $475.20. After his death was confirmed, the VA sent Mrs. Thomas a claim application which she was to fill out to receive the $5000 insurance policy, and recommended she seek Red Cross assistance in filling out the claim. Mrs. Thomas contended she did this, and a short time later got a reply from VA advising her they could not pay her the insurance because of a minority ruling in effect at the time of Hinds' death. The VA asserted she was not a foster-mother as listed on grounds she did not take care of Hinds until he became 21. Mrs. Thomas reported Hinds' parents died when he was 21, and that he came to live with her. She said she gave him a room, washed and ironed his clothes, and helped him with personal problems. Mrs. Thomas also has cited the fact the Army sent his Purple Heart to her. The Veterans Administration wrote her admitting she had conducted herself towards Hinds like a foster mother, but after he had passed his twenty-first birthday. She said the VA offered to pay her the premiums Hinds had paid while in service. Then, Mrs. Thomas sought the assistance of the American Legion in claiming the insurance. The Rockwood Post began work on the case, and John Burchfield, local service officer, obtained affidavits from several persons familiar with the relationship between Mrs. Thomas and her nephew. The Rockwood Legion post also voted to lend Mrs. Thomas $50 for use of a court reporter. Burchfield reported that the minority ruling governing foster parents had been changed in 1946 and that servicemen could not leave their insurance to anyone. Mrs. Thomas then contended that she had seven children of her own, and that Hinds had stayed with her since he was 21 with the exception of a short time he was married and when he was away on a job. She supported her claim as next of kin by siting Hinds' divorce later and absence of children or brothers and sisters. Attorneys recalled a recent case decided by the Federal District Court in Chicago (Zazove vs United States) in which judgement was awarded to next of kin. ROCKWOOD TIMES, OCTOBER 25, 1951 - FIRST PAGE SUPREME COURT UPHOLDS LEGION SPONSORED CASE Mrs. Lulu H. Thomas to Receive $5000.00 from VA after Long Fight The United States Supreme Court has upheld the findings of the Court of Appeals which recently awarded the $5000.00 insurance policy of the late Casper W. Hinds to his foster mother, Mrs. Lula Hickey Thomas. This case, which was sponsored and financed by Curtis E. Smith, Post No. 50, American Legion, and had been in litigation for several years, represents a victory for Mrs. Thomas over the Veterans Administration. The VA refused to pay Mrs. Thomas, claiming the insurance made out to her, claiming that she, as a foster parent, was ot entitled thereto. The case grew out of the death of the late Sgt. Casper W. Hinds in World War II. His insurance was made out to his Aunt, Mrs. Thomas, who had reared him from a small child to manhood. Cpl (Cpl or Sgt?) Hinds took out a $5000.00 National Service Life Insurance policy and named his aunt, Mrs. Thomas, as the beneficiary. At that time the statute which was in effect read as follows: "The Insurance shall be payable only to a widow, widower, child, parent (including persons in loco parentis, if designated as beneficiary by the insured), brother or sister of the insured. The insured shall have the right to designate the beneficiary of the insurance, but only within the classes herein provided." With the support of the Rockwood American Legion Post, the case was tried in two courts, with Mrs. Thomas the winner each time except in the first case in the district court in Knoxville under Federal Judge Robert Taylor. In the last decision, Judge Xen Hicks, of the United States Court of Appeals, in Cincinnati, ruled in favor of Mrs. Thomas, but the VA appealed to the Supreme Court. Mr. Russell R. Kramer, Knoxville, and Jess E. Pearman, Harriman Attorney, assisted by Lloyd G. McCluen, have worked tirelessly on the case and the local legion post chiefly through the efforts and help of John Burchfield, Service Officer, deserve much credit for the success of the case which was carried to the nations highest tribunal. Mr. Kramer announced Friday that the Supreme Court had denied the writ of Certiorari, which meant that they affirmed the findings of Judge Hicks' Court of Appeals and Mrs. Thomas will receive the $5000.00 under the insurance policy of her nephew and foster son, Casper W. Raymond Thomas, 46, a Rockwood taxi driver, and his cousin, Mrs. Reba Thomas Wyatt, of Kingston and their mothers, who are sister-in-laws, were reunited recently when Mrs. Wyatt's mother Mrs. Addie Thomas Hamilton thumbed through the phone book in an effort to locate their relatives. She found the name of Mrs. Lula Thomas on Rockwood and promptly phoned to say she and her daughter were living in Kingston. Raymond Thomas, son of the late John Thomas and Mrs. Wyatt, daughter of the Late Roscoe Thomas, were living at Lake Waldensia with fathers working in the mine, at the time the two families seperated (sic). "Both families were living in the same house and when we seperated (sic) Roscoe Thomas died and his wife remarried making it hard to trace the members of the family." Raymond explained. Mrs. Wyatt moved to Kingston and during the time made only a few visits to Rockwood. He said he had made several efforts to learn the whereabouts of his cousin, Mrs. Wyatt and her brother Zirkle Thomas, now living in Knoxville.
