On the 25th day of July 1832 personally appeared in open Court it being a Court of Record, Carter Barnett, a resident of the County of Roane aforesaid aged about 72 years who being duly sworn according to Law doth on his oath make the following declaration in order to obtain the benefit of the provisions made by the act of Congress passed 7th June 1832 that he enlisted as a marine in the naval service of the United States, at Newburn in North Carolina about 1780 - or '81 Under Captain Tatum. Peter Frubish was mate. He enlisted again in Charleston South Carolina on board the Brig Randolph Commanded by John Wallace, Captain and Joseph Wallace made Boatswain George Tate Frenchman he enlisted for 18 months serving out 17 months he was transferred to the Merchantsman Nancy with William Nichols and mate Joseph James. The Capture was made by a sooner Punch as he believes belonged to Jamaica. He received no discharge. He had lost his discharg received from the first service and received no discharge from the last service. He hereby relinquishes every claim thatever to a pension or an annuity except the present and he declares that his name is not in the pension Roll of any agency in any state. The only clue to who the father may be is from a death record of a Joseph Wiley Leffew, which states that his father was Joshua Brown from Tennessee. No mother was listed. His date of death is 1918, which would coincide with the information given by William J. Warner regarding Joseph. He stated that his grandfather had died long before he was born, during the flu epidemic and that he never knew him. This Wiley died after the births of all the children known to belong to the Joseph Leffew in question, so this is a very strong possibility. The only other suggestion is that the three boys actually belonged to another Leffew sibling and Jerusha just took them in as her own. This was a doubly bad date, as it was a Sunday. In 1858, Sterling was charged with Profanity, copy of original on file. In the 1860 Roane County Census, Sterling and Jerusha were living in the 11th District on the 9th of August in Barnardsville, Tennessee. It is also reported that he died at the General Hospital #2 on April 12, 1864 of disease. Company F listing has not been found, and is thought destroyed, but Surgeon General reported a private S. Leffer as having died April 12, 1864 at general hospital #2 in Richmond, Virginia. The same pension claim lists children 1 through 6. Also the marriage of Sterling and Jerusha is listed as July 16, 1846. The pension application is dated April 8, 1864 from Loudon County, Tennessee. Sterling Leffew had lived in Roane County, Tennessee. The last three children are listed under Jerusha only because Jerusha states they are her sons in the 1880 Roane County Census. When sixteen years old he began life independently, and in 1855 went to California, where, for the first four years, he worked on a stock ranch. He afterward combined butchering and stock-raising, and in 1866 returned to Tennessee, where he has since resided. In December 1867, he married Ruth Caroline, a daughter of L.J. HINDS, a native of Roane County. Their children are William C., Rilla C., Nora L., Samuel B., Martha E., Katie K. and Ella M. The eldest daughter and her parents are members of the Christian Church. In politics Mr. Hinds is Conservative, and first voted for LINCOLN. He is the third of four children of John and Sarah A. (HICKEY) HINDS, the former born and reared in Roane County, and the latter born in Knox County, but a resident of this county since childhood. The father, an excellent farmer, was captured and held as prisoner at Chattanooga for three months during the late war. The grandfather, Sylvanus HINDS, and a brother were the pioneers in honor of whom Hinds Valley received its name, and the former was a soldier of the Creek Indian war and that of 1812. Hickey who used to reside at this place died at his home in Rockwood Sunday night after a lingering illness with dropsy, aged about 53 years. He leaves a wife and nine children, three brothers and one sister, besides a large host of relatives and friends to mourn his departure. His remains were brought here Tuesday for burial in the family graveyard. another account in the same newspaper: John M. Hickey died at his home in this city Monday from dropsy at the age of 56 years. He descended from a family of that name that settled in Hinds Valley long before Tennessee was a state and he was born and reared there. He has a large connection in this county. His remains were taken to the Glenalice cemetery and enterred, Tuesday. He was a member of the Christian church at Glenalice for many years prior to his death. HICKEY The community was shocked last Sunday morning when news was received that H. C. Hickey was dead, which was sad news to his many friends and relatives. He was about 50 years of age. Mr. Hickey had recently returned from a stay of about ten months in the west and had gone to work in the coal mine at Rockwood, where he was seriously injured on Jan. 25 and was taken to Chamberlain Memorial Hospital, where the end came. He was married to Miss Mary Egel at the age of 18 years. To this union were born three sons, Rufus, Chas., and Harvey Hickey, all of whom survive him. He leaves besides his children, two brothers, Holman and Preston Hickey of this place, and one sister, Mrs. Mollie Mynatt, of Knoxville, and a host of relatives and friends. The life of this good man stands today as an open book, and as he is gone the memory of him will still live on forever. "Uncle" Pete as he was called, was a friend to man, ever ready to help those about him in need. Every girl or boy who knew him learned to love him. During his great suffering he would make inquiry of the children, and wanted them to come to see him. He was cheerful and hopeful until the very last. His friends visited him during his illness and said he would greet them with a smile and handshake and invite them back to see him. He was conscious to the last. He said he was ready to go and was only waiting for God to call him home, where sickness and death are feared no more. Mr. Hickey was a man that loved to travel. He had been all over the United States, has been given up as dead several times, but after so long a time he would return, telling about where all he had been. Earth has lost an honest, truthful man and the order of Odd Fellows has lost a highly repected brother. This we know--no truer, no purer spirit ever winged its flight over there. His remains were taken Sunday morning to the undertaking establishment and prepared for burial. Services were conducted Monday afternoon at 2 from the Christian church by the pastor Leland Cook, who made a brief talk on the life and character of the deceased. The remains were then taken to Odd Fellows and the body consigned to its last resting place, there to await the resurrection morn. The writer wishes to extend to the bereaved relatives her deepest sympathy in the loss of their loved one. M. C. H. Hickey, aged 56, died Tuesday afternoon at 1:50 at his home south of Rockwood after a Reif illness of pneumonia. He was a veteran of the Spanish American War and had resided in Roane County all his life. He is survived by his wife and several children. Funeral services were conducted this (Thursday) afternoon at the Glen Alice Christian church, with Rev. Chas. E. Jackson, of Rockwood, officiating. Members of Curtis E. Smith Post, American Legion, were in attendance and the veteran was buried in the Glen Alice cemetery with full military honors. Spanish War Veterans Hickey Pall Bearers Spanish-American War veterans have informed The Times that members of A. B. Peters Camp, United Spanish War Veterans, participated in the funeral of Holman B. Insurance of a Rockwood Soldier killed in action in 1942 can be withheld by the Veterans Administration under a 1946 ruling is an issue Judge Robert L. Taylor, new Federal Judge, must decide in a case set for Jan. 24th. Amount of the insurance is $5000 and the policy was sworn out by Cpl. Casper W. Hinds when he entered service in 1942, and listed Mrs. Lula Hickey Thomas as next of kin. Hinds was killed while serving with the Army in the Mediterranean late in 1942. When at first he was reported missing in action, Mrs. Thomas got the official notification, and the Army sent her the soldier's gratuity pay for six months of $475.20. After his death was confirmed, the VA sent Mrs. Thomas a claim application which she was to fill out to receive the $5000 insurance policy, and recommended she seek Red Cross assistance in filling out the claim. Mrs. Thomas contended she did this, and a short time later got a reply from VA advising her they could not pay her the insurance because of a minority ruling in effect at the time of Hinds' death. The VA asserted she was not a foster-mother as listed on grounds she did not take care of Hinds until he became 21. Mrs. Thomas reported Hinds' parents died when he was 21, and that he came to live with her. She said she gave him a room, washed and ironed his clothes, and helped him with personal problems. Mrs. Thomas also has cited the fact the Army sent his Purple Heart to her. The Veterans Administration wrote her admitting she had conducted herself towards Hinds like a foster mother, but after he had passed his twenty-first birthday. She said the VA offered to pay her the premiums Hinds had paid while in service. Then, Mrs. Thomas sought the assistance of the American Legion in claiming the insurance. The Rockwood Post began work on the case, and John Burchfield, local service officer, obtained affidavits from several persons familiar with the relationship between Mrs. Thomas and her nephew. The Rockwood Legion post also voted to lend Mrs. Thomas $50 for use of a court reporter. Burchfield reported that the minority ruling governing foster parents had been changed in 1946 and that servicemen could not leave their insurance to anyone. Mrs. Thomas then contended that she had seven children of her own, and that Hinds had stayed with her since he was 21 with the exception of a short time he was married and when he was away on a job. She supported her claim as next of kin by siting Hinds' divorce later and absence of children or brothers and sisters. Attorneys recalled a recent case decided by the Federal District Court in Chicago (Zazove vs United States) in which judgement was awarded to next of kin. ROCKWOOD TIMES, OCTOBER 25, 1951 - FIRST PAGE SUPREME COURT UPHOLDS LEGION SPONSORED CASE Mrs. Lulu H. Thomas to Receive $5000.00 from VA after Long Fight The United States Supreme Court has upheld the findings of the Court of Appeals which recently awarded the $5000.00 insurance policy of the late Casper W. Hinds to his foster mother, Mrs. Lula Hickey Thomas. This case, which was sponsored and financed by Curtis E. Smith, Post No. 50, American Legion, and had been in litigation for several years, represents a victory for Mrs. Thomas over the Veterans Administration. The VA refused to pay Mrs. Thomas, claiming the insurance made out to her, claiming that she, as a foster parent, was ot entitled thereto. The case grew out of the death of the late Sgt. Casper W. Hinds in World War II. His insurance was made out to his Aunt, Mrs. Thomas, who had reared him from a small child to manhood. Cpl (Cpl or Sgt?) Hinds took out a $5000.00 National Service Life Insurance policy and named his aunt, Mrs. Thomas, as the beneficiary. At that time the statute which was in effect read as follows: "The Insurance shall be payable only to a widow, widower, child, parent (including persons in loco parentis, if designated as beneficiary by the insured), brother or sister of the insured. The insured shall have the right to designate the beneficiary of the insurance, but only within the classes herein provided." With the support of the Rockwood American Legion Post, the case was tried in two courts, with Mrs. Thomas the winner each time except in the first case in the district court in Knoxville under Federal Judge Robert Taylor. In the last decision, Judge Xen Hicks, of the United States Court of Appeals, in Cincinnati, ruled in favor of Mrs. Thomas, but the VA appealed to the Supreme Court. Mr. Russell R. Kramer, Knoxville, and Jess E. Pearman, Harriman Attorney, assisted by Lloyd G. McCluen, have worked tirelessly on the case and the local legion post chiefly through the efforts and help of John Burchfield, Service Officer, deserve much credit for the success of the case which was carried to the nations highest tribunal. Mr. Kramer announced Friday that the Supreme Court had denied the writ of Certiorari, which meant that they affirmed the findings of Judge Hicks' Court of Appeals and Mrs. Thomas will receive the $5000.00 under the insurance policy of her nephew and foster son, Casper W. Raymond Thomas, son of the late John Thomas and Mrs. Wyatt, daughter of the Late Roscoe Thomas, were living at Lake Waldensia with fathers working in the mine, at the time the two families seperated (sic). "Both families were living in the same house and when we seperated (sic) Roscoe Thomas died and his wife remarried making it hard to trace the members of the family." Raymond explained. Mrs. Wyatt moved to Kingston and during the time made only a few visits to Rockwood. He said he had made several efforts to learn the whereabouts of his cousin, Mrs. Wyatt and her brother Zirkle Thomas, now living in Knoxville. Thomas is the father of six children while Mrs. Wyatt is the mother of two children. Mrs. Wyatt has one brother and Thomas said he was the only child.
