Deeds, vol. 2A 1750-1766 pp.139-140 NOW all men by these presents that whereas Mathew Wallace in his lifetime was possessed of a Considerable Estate in Lands & Chattles Sd lands lying in Peters Township in Cumberland County and Whereas before his decease he had a Will wrote tho not perfitted Wherein Sd Land lying in Sd Township upon Licking Creek was left or Bequeathed unto his two Sons James and Ezekial Wallace and altho Sd will was not perfected by Sd decedant yet we Arthur Alexander, Andrew W.Willoughby and William and being Sonsinlaw and heirs to Sd Mathew Wallace Deceased as we believe Sd will or Instrument of Writing tho not per perfected was Agreeable to the mind and will of Said Decedant we Acknowledge our Selves fully Cc content with the Contents thereof & we Acknowledge that we have Received from Sd Ezekial Wallace our full parts or Legacies of Sd decedants Estate agreeable to Sd Will or Instrument of Writing and we do hereby in the Name and behalf of our Selves our heirs Exts Admn and Assigns for ever quit Claim to and Interest in the Sd Estate as well Real as personal and Further we hereby give our full free and hearty Consent to the Sd James Wallace & Ezekial Wallace or either of them or either of their heirs etc to obtain a patton or Pattons for the Sd Land lying as above Described And we hereby bind our Selves our heirs Exts & Admns in the penal sum of five hundred pounds Current Money of Pennsylvania to Save Indamnifyed the Sd James & Ezekiel Wallace their heirs Exts Admns and Assigns from any person or persons Claiming Sd Tract of Land from by or County upon each Side of Licking Creek and Whereas Sundry years before his Decease he gave of to me James Wallace (being his Son) that part of Said Land lying upon the South side of Sd Creek which part is now Confirmed to me by my Brother Ezekiel Wallace by an Instrument of Writing of Same Date with these presents I do hereby acknowledge that Said part so Confirmed together with what I got at the time of my Marriage and Twenty pounds now Recvd or Secured by my Brother Ezekiel is in full of all my part of Said Land & Chattles Possessed by my father in Sd Township And I do hereby give my full` and free Consent that he the Said Ezekial Wallace or his heirs Exts Admns and Assigns Obtain a patton or Deed for that part of Said Lands lying on the North Side of Said Creek that my said father lived upon (Page 140) Now possessed by Said Ezekiel And further I do hereby bind my self my heirs Exs & Adms in the penal sum of four hundred pounds Current Money of Pennsylvania to Save Indemnified him the Said Ezekial Wallace his heirs Exs Admns and Assigns from any person or persons Claiming Sd part of Said Lands Lying on Sd North Side of Said Creek as from by or under me as a Bond bearing Date even with these presents from my Son Ezekial Wallace wherein he obliges himself to pay me five pounds Yearly & every Year during my Natural Life I do hereby acknowledge Said Bond to be in full Satisfaction for my Interest in and Claim to the Lands or Real Estate of my Said husband Deceased And I do hereby in behalf of my self my heirs Extr & Admn for ever quit Claim to and interest in all that Lands or Real Estate of Said Decedant And I do hereby give my free Consent that he the said Ezekiel or his heirs Exts Admns or assigns obtain a patton for Sd lands and I do hereby bind my Self my Heirs Exts Admns and Assigns in the penal sum of two hundred pounds Current Money of Pennsylvania to Save Indamnified as well him the Said Ezekial Wallace as all other person their heirs Exts Administrators & Assigns from any person or persons Claiming Said Land formerly belonging to my Sd Husband Deceased As witness my hand and Seal this twenty third Day of August and in the
