This indenture made and entered into this 8^th day of December 1842 between Ambrose Phelps of the County of Caswell and State of North Carolina of the one part and Barnel Russell of the County of Person and state aforesaid of the second part name this indenture witfeth? that whereas? the said Ambrose Phelps stands? Xxxx indebted? to the following persons, xoulitx to Barnel Russell in the sum of ten dollars and 55 cents due on bond? the 20^th April 1838 and Mary? Russel in the sum of sixty dollars due on bond? the 28th December 1841 and to Thomas Phelps Sr? in the sum of one hundred and forty eight dollars due on open? xx to Braneard Badshin? the sum of fifteen dollars due on open account and Braneard? Winstead? in the sum of twenty dollars due on judgement and to Joseph? I? Thompson in the sum of about sixteen dollars due on bond one? note? all which debts the said Ambrose Phelps is dedenang? to ficune? and afune? to the several persons herein named together with all the interest that has or may accrue thereon? save this indenture fathen? witnxxx that for and in consideration of the sum of one dollar to him the said Ambrose Phelps in hand paid? by the said Burnell Rufel/Russel? hath this day bargained? sold and delivered? to the said Rufel/Russel xxx xxxx one tract of land lying in the County of Caswell on the xxxx of South Hico? Creek adjoining the land of Jacob Thomas – William Fuller? and others containing one hundred and five acres more or less. Also my crop of corn foddling? And tobacco and xxx stock of hogs and xxx house and xxx one yohe of oxen – household and kitchen furniture my stack of xxxx xxxx aaa trust?

And confidence that if the said Ambrose Phelps fails to pay or cause to be paid to the several persons xxxx xxx on or before 25^th December 1845 and in that case? it shall and may be lawfull? for the said Barnel Russell on his legal xxxxxxxxxx on any acting for him and by him authorized to proceed to sell said property aforesaid to the highest bidder for cash after giving reasonable notice of time and place? of such sale and moneys? arising? therefrom? shall pay and satisfy the several debts xxx mentioned? to the Rxxxx authorized? to receive? the same? fxxx paying xxxxxxxxxxxx sum? for carying? this trust into xxx and the xxx if any pay to the said Ambrose Phelps or his xxx the said Phelps doth for himself and his xxx ccc that at the time of executing this indenture he is signed? and xxxxxx of a good and lawful title to said property aforsaid? which property he will forever xxx and defend to the said Ruffell/Russell and xxx xxx and xxx foxxxx.
