In the name of God amen, the 2nd day of July in the year of our Lord God 1801, I, Jethro Meltear of the County of Gates and State of North Carolina being sick in body but good and sound memory thanks be to Almighty God & calling to remembrance the uncertain estate of this transitory life and that all flesh must yeild to death when it shall pleas God to call do make, constitute, ordain, & declare this my last will & testament, in manner and form following, revoking and annulling by these presents all and every Testament or Testaments, Will & Wills heretofore by me made & declared wither by word or writing & this is to be taken only for my last will and testament and none other and first being peristant and sorry for my past sins most humbly desire forgiveness for the same, I give and commit unto Almighty God my saviour and redeemer, and my body to be buried in such a place where it shall please my executors hereafter named to appoint and now for the setling my temporal estate which has pleased God to bestow upon me, I do order, give, and Dispose the same in manner & form following that is to say First I will that all the debts & dues I owe in right and Justice to any person or persons whatsoever shall be well and truly contented & paid within conveanent time after my decease by my executors hereafter named.
Item. I give to my beloved wife, Mary Miltear, the use of the property I now possess consisting of the land and plantation I now live on and all my other lands, also one negro man named Hardy, one negro woman named Pegg, and one negro girl named Darcas, together with all my stock of every koindall dureing her natural life and after her decese to be divided amongst my three sons, Benjamin Miltear, Jethro Miltear, & James Miltear exclusive of that part of my estate which I shall hereafter give away.
Item. I give to my beloved son Benjamin Meltear my percoson pattern land and the above mentioned negro girl Darcas to him and his heirs forever.
Item. I give to my beloved son Jethro Meltear my negro man hardy, also my young horse called Figure & one bed and furniture to him and his heirs forever.
Item. I give to my beloved son James Miltear the land and plantation I now live on, also my negro woman Pegg, also one bed and furniture, also the choice of my two yoak oxen to him and his heirs forever.
Item. I give to my beloved daughter Elizabeth Blanchard one cow and calf, one yew and lamb, and one stock of bees to her and her heirs forever.
Item. I give to my two daughters Sarah Meltear and Mary Meltear fifty pounds a peace to be raised out of my estate provided one or both of them dies without ishue, the money to be and remain and reamin in my estate.
I hereby do appoint my beloved son Benjamin Miltear, Jethro Miltear, and James Miltear my whole and soul executors of this my last will & testament. In witness whereof I have hereunto set my hand seal this day & date above written. Signed, sealed, & delivered in the presents of us John (his x mark) Murfree, Thomas Marshall.
