WILL OF EZEKIEL T. DAUGHERTY Russell County, Virginia Will Book 8, Page 220 Executed 04 Feb 1868 I Ezekiel T. Daugherty of the County of Russell & State of Virginia being of sound mind and disposing memory do hereby make my last will and testament in manner and form, to wit that is to say,
First I desire that out of my estate that all my just debts and funeral expenses be paid.
2nd I give and bequeath to my son Andrew Daugherty my tract of land upon which I now live to include all the land I own.
3rd my desire is that after my decease that my son Andrew take my daughter Polly to his house and take good care of her as long as she lives.
4th I give to my daughter Polly all my household and kitchen furniture together with whatever stock of any discription that I may die possessed o
5th I desire that my son Andrew pay to my daughter Routh Whitt two hundred dollars within five years after my death.
6th My desire is that my son Andrew pay to daughter Martha Boswell two hundred dollars, to be paid to her or her heirs as the case may be within five years after my decease; or sooner if my son sees proper to do so.
7th I desire that whatever proper such as farming tools any other articles of property not named, together with my cupelo stock including coal & mettle, I give to my son Andrew including all my tools of every discription.
8th And lastly I constitute and appoint my friend Isaac Vermillion executor of this my last will and testament, revoking all other or former wills by me hertofore made, witness my hand and seal this 20th day of January 1868.

Daugherty was this day produced in court by Andrew Daugherty and the subscribing witnesses thereto failing to appear, it was ordered that the same be laid over till the next term, and that the said witnesses thereto be summoned to said term that said will may be proved, Teste J. C. Gent D. C.
At a court of quarterly session held for Russell County at the court house on the 3rd day of March 1868 The last will and testament of Ezekiel T. Daugherty was again produced in court and proved by the oaths of Abram Thomas and Nancy Williams the two subscribing witnesses thereto, and ordered to be recorded, and thereupon Isaac Vermillion the executor therein named appeared in court and refused to take upon himself the burthen of execution thereof.

At a court of quarterly session continued and held for Russell County at the court house on the 6th March 1868 On motion of Isaac Vermillion the executor set forth in the last will and testament of Ezekiel T. Daugherty dec'd, who took the oath of an executor prescribed by law and entered into and acknowledged his bond in the sum of $200, together with Andrew Daugherty as his security thereto conditioned as the law directs, a certificate is therefore granted him for obtaining probate of said will in due form.
