James enrolled with the 96th at the age of 50 in Pottsville.The majority of those recruited were from Schuylkill County.Prior to the 96th, James served in the 25th PA Volunteers, Company D as a 1st Lieutenant.James Russell and his men were involved with many significant battles during the Civil the war.One of which was the Battle of Gaines' Mill.This was the 3rd battle of the Seven Days War, in which GeneralRobert E. Lee had launched the largest Confederate Offensive up to this point.Casualties were very high and in this Battle, the 96th PA had lost 13 men and another 59 wounded.One of these wounded was Captain James Russell.The blast from an enemy shell caused him to lose his hearing in the right ear.James had also been wounded at the Second Battle of Fredericksburg.

On this 6th day of January, A.D. one thousand eight hundred and eighty-seven personally appeared before me, clerk of the Quarter Sessions, a court of record within and for the county and State aforesaid, James Russell aged 75 years, a resident of the borough of Tamaqua, county of Schuylkill, State of Pennsylvania, who, being duly sworn according to law, declares that he is the identical James Rufsell who was enrolled on the 20th day of August, 1861, in company "E" of the 96th regiment of Pennsylvania Volunteers commanded by himself, and was honorable discharged at Hestonville, West Philadelphia, Pa., on the 21st day of October, 1864; that his personal description is as follows: Age 49 years; height, 5 feet 51/2 inches; complexion fair; hair brown; eyes grey.That while a member of the organization aforesaid, in the service and in the line of his duty at Gaines' Mill, in the State of Virginia on or about the 27th day of June, 1862, he, while in the discharge of his duty, while the regiment was moving from the field near the termination of the fight, was knocked over and stunned for the time being, by the ? or effect of a solid shot or shell fired from one of the enemies guns, through which cause he was and still continues to be totally deprived of hearing though the right ear.
That he was not treated in hospitals: not desiring to go there, he continued to have hearing through his left ear until about 1883 when through ?, the said hearing also became impaired, ?. That he has personally been employed in the military or naval service otherwise than as stated above as a 1st Lieutenant in Company "D", 25th Regiment Pennsylvania Volunteers, his term of service in which commenced April 18th, 1861 and expired about August 3rd, 1861.He being on ? duty when the regiment was mustered out.That since leaving the service this applicant has resided in the County of Schuylkill in the State of Pennsylvania, and his occupation has been that of a Lumberman.That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled.That he is now disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension-roll of the United States.
He hereby appoints, with full power of substitution and revocation, John T. Boyle of Pottsville, State of Pennsylvania, his true and lawful attorney to prosecute his claim.That he has never received nor applied for a pension.That his Post Office Address is Tamaqua, county of Schuylkill State of Pennsylvania.
Also personally appeared John T. Boyle, residing at Pottsville and George Rahn, residing at Pottsville, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say they were present and saw James Russell, the claimant, sign his name (or make his mark) to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with him, that he is the identical person he represents himself to be; and that they have no interest in the prosecution of this claim."
