Jasper stated on the Claimant's Affidavit for a military pension that he suffered from cold, hawking and spitting caused from catarrh of head or throat, a continual tired feeling, sweating spells at night, shortness of breath, rheumatic pains of joints, sleeplessness, a chilly sensation between shoulders, upset nerves when indulging in manual labor or mental excitement, weakness, trembling, irregular pulsations of heartbeat, and none of said ailments were due to vicious habits. At the time of his death, Jasper C. Woodworth was reported to have been A.W.L. from the Battle Mountain Sanitarium, National Home for Disabled Volunteer Soldiers, located at Hot Springs, SD. Jasper's military pension at that time was listed as $30 per month. In the History of Wayne & Clay Counties, Illinois, J.C. From the Adams County Democrat, 11 Feb 1916, page no. 1: A Little Interesting History Editors Democrat: I submit here with a brief bit of personal history covering over forty-four years of sojourn in Adams county for your consideration, which is not given in the spirit of self aggrandisement, but facts as near as possible, briefly stated. We came to Nebraska in 1871 and I preempted the northwest quarter of section two, in Ayr township, where I broke forty acres in the spring of 1872, hauling the water we used for house use and four head of horses and a cow from Thirty-two Mile Creek, about a mile and a half away. I had not the money necessary to put down a well to lighten up the burdens of life, so I traded that quarter for the one where we now live and moved onto it in August 1872, but our new house did not let us down to the Little Blue, so I bought an eighty of railroad land on ten years time, which took in about one-half mile of the river with quite a lot of timber which was quite an object in those days. I constructed a dugout 16x24 of two rooms, then an additional dugout fifteen feet square, which was for the purpose of our best room. So we lived altogether about nine years with the Nebraska's native soil for a roof over our heads - rather humble of course, but in those days we had to do as we could, not as we would have liked to have done. We are fairly well fixed now, but I believe we lived just as happy in those days of long ago as we do now. We came to Nebraska with three little kids and ten others were added to the number making an even baker's dozen, all of whom are alive today, all married and gone, and as a result we have about thirty-six grandchildren and two great grandchildren. We are the only family living on their homestead in Ayr township that came here in 1871. The first child born in the county was born in our dug-out. I believe I bought the first railroad land the Burlington sold in the county in June, 1872, before the railroad had a patent from the government. The first school taught in school district 53 was taught in our dugout by Robert Ratcliff. The second school was also taught in our humble abode by Maggie Warwick. Have taken The Democrat ever since its birth, I think the paper was started by Dick Thompson. Never took a paper without first paying for the same in advance. Never run a store debt. Never went on another's note nor asked anyone to go on mine. Never bought a piece of machinery on time. It was not that I was flush with money that I adopted the cash system, but because I wished to keep out of debt - as is the old saying, "Pay as you go then what you have you'll know." One has to practice a great deal of economy and self denial to keep straight with the world, but I believe its the best resolve that one can make, and it would be much better for everybody if the rule was generally adopted. Well, eventually fortune smiled on my efforts and I became the possesser of 646 acres of land, and if I owed a dollar I did not know it. Father time began to make demands upon my abilities greater than I was able to bear up under, so we gave to the children 540 acres of the 640, leaving us an eighty, forty acres of which is a part of the original homestead. I have felt much relieved since the division and I think the children appreciated it as much before as they would after we had passed away. In regard to our family, let me say that I never struck one of them. In honor, honest and integrity, I am willing to compare notes an other family in the state. I feel proud of them. To close I will say that if I live till the 15th of August next I will have lived 75 years, and if I and companion live till the 24th of next April we will have been married fifty years. J.C. Woodworth. Ayr, Nebr., Feb 3, 1916. Last Will and Testament of Jasper Charles Woodworth I, Jasper C. Woodworth of the township of Ayr, County of Adams and State of Nebraska, realizing the uncertainty of this life and being of sound mind and memory, do make, publish and declare this to be my last will and testament, that is to say; First. I direct that my funeral expenses, the costs of administration and all my just debts be paid in full out of my personal property, and in the event that my personal property should not be sufficient for that purpose I hereby authorize and empower my executors hereinafter named to sell so much of my real estate as may be necessary to pay said debts. Second. I direct my executors hereinafter named to use the sum of $150 with which to purchase a suitable head stone to be erected at the head of my grave. Third. I give, devise and bequeath unto my son, Andrew Woodworth the sum of $100.00 in cash to be paid to him by my said executors in recognition of his faithful services during my life time. Fourth. I give, devise and bequeath to my son, Sherman Woodworth, the sum of $100.00 in cash to be paid to him by my said executors in recognition of his faithful services during my life time. Fifth. I give, devise and bequeath unto my daughter Minnie Woodworth the sum of $50.00 in cash to be paid to her by my said executors in consideration of her faithful services during my life time. Sixth. I give, devise and bequeath unto my wife, Melissa Woodworth, and direct that she shall have all the rights, title, interest, estate and benefit in and to all of my estate as is now provided for by law. I further nominate and appoint her her as the sole guardian of the person and estate of my minor children. Seventh. I further direct that after the payment of all debts costs, expenses and legacies as hereinbefore provided that the rest, residue and remainder of my estate, both personal and real, shall be divided, share and share alike, to my children, subject however to the interest and estate of my said wife, Melissa, as set forth in paragraph six. Eighth. I further direct that in the event of the death of any of my said children without issue then the share of such child or children shall be equally divided among all the children surviving at my death. Ninth. But in the event of the death of any of my said children leaving issue then the share of such child shall be divided equally among his or her children. Tenth. I hereby nominate my sons, Andrew Woodworth and Sherman Woodworth as joint executors of this my last will and testament. Eleventh. I hereby revoke all former wills by me at any time made. Dated at Hastings, Nebraska, this 4th day of March, A.D. 1904 Jasper C. Woodworth Signed, sealed, published and declared as and for his last will and testament by the above named testator in our presence, and we have at his request and in his presence and in the presence of each other signed our names hereunto as attesting witnesses. W.R. Alexander Hastings, Nebraska W.W. Dungan Hastings, Nebraska Codicil to my last will To those whom it may concern I wish to change that part of my last will relating to my sons Andrew and Serman giving to them ($100.00) one hundred dollars each and my daughter Minnie ($50.00) fifty dollars more than the other heirs of the family were to get in making an equal division of the estate. That part of the will is repealed for the reason that I have made good those amounts to said heirs while yet in this life by paying in cash said amounts in full. Further it is my wish and desire that, should any of the heirs attempt at law to break my will he, or she, or they, shall be debared from any further interest in the estate whatever, as I have already given them 560 acres of the 640 besides considerable money. Dated this the 5th day of September 1916 Jasper C. Woodworth Witness Chas C. Larsen Ellen R. Larsen From the probate records: The court further finds that said Jasper C. Woodworth, deceased, left surviving him as his only heirs at law, devisees, and legatees under the Will, and only persons interested in said estate the following named persons, to-wit:-- Melissa Woodworth, widow, Ayr, Nebraska Andrew A. Woodworth, son, Ayr, Nebraska Charles A. Woodworth, son, Ayr, Nebraska Frank H. Woodworth, son, Ayr, Nebraska Minnie E. Giddings, nee Woodworth, daughter, Blue Hill, Nebraska Hila F. Monahan, nee Woodworth, daughter, Moosejaw, Canada. That said Jasper C. Woodworth left no father or mother, nor otehr child or children, nor any child or children of any deceased child him surviving. From the Adams County Democrat, 29 Mar 1918, page no. 10: Jasper C. Woodworth was born in Union county, Ohio, August 15, 1841, died March 14, 1918 at the age of 76 years, 6 months and 29 days. August 12, 1862, at the age of 21 years, he enlisted in Co. A. 121st Ohio, Vol. Inft. and served to the close of the war April 24, 1866, he was married to Melissa McCumber of Woodstock, Champaigne County, Ohio. To this union thirteen children were born: Andrew, Sherman, Henry, John, William, Mrs. Emma Kohl, Mrs. Anna Finnerty, Mrs. Ida Easter, all of Ayr, Nebr.; Mrs. Minnie Giddings, Blue Hill, Nebr.; Mrs. Ella Kelley, of Burley, Idaho; Mrs. Susie Brake, of Marysville, Ohio; Pearl Woodworth of Hastings, Nebr.; Mrs. Lucy Monahan, of Moose Jaw, Sask., Canada. These children, all living, with the wife and mother are left to mourn. Deceased also leaves two aged sisters and seven brothers. Four of the brothers and the two sisters live in Ohio. One of the brothers is a missionary at Tokio, Japan, and one brother is a resident of Montana. There are 36 grandchildren and 5 great grandchildren. Mr. Woodworth came to Nebraska in 1871, locating on the homestead north of Ayr, where he spent the remainder of his life. He was one of the advance guard - earliest settlers - to locate in Adams county and this portion of Nebraska in the days when the buffalo and the Indian still roamed these broad prairies and six years before the town of Ayr was incorporated. Mr. Woodworth was the first settler in that portion of the county and state to erect a substantial residence, building a two-story dwelling of concrete which was a very commodious and substantial farm home for those days. At that time the most of the pioneer settlers lived in sod houses or dug-outs. He was one of those courageous settlers who had faith in the soil and future of this country and lived to see it become one of the most highly improved, cultivated and prosperous places in the world, and is entitled to the full measure of credit for his individual part in this development for as the years passed by his frugality and enterprise he built and prospered, and at this death was rated among the large land holders in that part of the county. The funeral, conducted by Rev. Lapp, of Roseland, was held from the Methodist Methodist church at Ayr, Monday afternoon, March 18, and was one of the largest ever witnessed in that part of the county, old residents and friends attending from far and near. The following six sons carried the remains to the last resting place in the family lot in Leroy cemetery: Sherman, Henry, John, Andrew, William and Pearl. |
