San Jose Mercury Herald, Wednesday Morning, November 2, 1926 Supervisor of '70 Buried by Garden City Odd Fellows Little known to many San Joseans of the preesent-day but a prominent figure in county circles and the community life of half a century ag0 and a man beloved by those early pioneers--many now passsed away--who were his business (partners and friends.) John M. Battee was laid to rest at Oak Hill yesterday. One of the oldest members of Garden City Lodge, I.O.O.F. which had charge of the funeral. Mr. Battee died October 30, at the age of 93 years after a life of usefulness and energy, which left its mark in mmany ways upon the Santa Clara vallley, running well over the allotted three score years and ten. Passages from H. S. Foote's book edited in 1888, "Pen Pictures From the Garden of the World," and carefully penned reports--now slightly faded by age--of the county superviors' meetings of 1870 and later, record events of that period in which Mr. Battee figured. Supervisor 1870 to '78 He took office as a county supervisor on March 7, 1870, and continued as a member and chairman of the board until March 4, 1878. This was a period when San Jose was growing stedily and beginning to assume proportions other than a town, other than the center of an agricultural district. It was on June 2, 1874, that James Lick executed his first trust deed whereby his estate was given to charitable and educational work, among the provisions of that document being those giving $25,000 for the purpose of establishing an orphan asylun here and appropriating $700,000 for establishing an observatory on land belonging to him near Lake Tahoe, Placer county. Gratitude for the former gift, in resolutions prepared by Judge Bleden, was so deeply acknowledged that Mr. Lick changed the location for the observatory and in August 1875, with Hon. B. D. Murphy, then mayor of San Jose, visited Mount Hamilton. The boaard of supervisors was then addressed, the offer to locate the observatory being made if the county would construct a road to the summit. Chairman Road Committee In the aforementioned book, the work of Mr. Battee in promoting this road is taken up in a chapter devoted to roads and highways: "Januaary 9, 1877, the Lick board of trustees and supervisors made an officail inspection* * * observed as a general holiday throughout the county. Probably the most earnest and untiring friend of the road was Supervisor J. M. Battee, chairman of the road connittee. To his devotion to the cuase is due, more than to any other man, the successfully termination of the great work that has attracted the attention of the scientific world to the summit of Mount Hamilton." To the few pioneers remaining who knew Mr. Battee, he is remembered as a man who was modest, plain in appearance and speech, determined, honest in all his dealings and one of the most far-sighted and efficient county officials of the closing quarter of the past century. Many obstacles faced the supervisors in building the road. Mr. Battee stood staunchly through them all. The valuation of the county then was about 40 millions. To build a road costing approximately $135,000 was considered quite a bite from the tax levy. Under Battee's guidance, the road was built without a bond issue, excepting for a small portion totaling about $12,000 at the mountain end. For years, the Battees resided at their home on Sunol street. In recent years Mr. Battee lived with a son at Los Gatos. He is survived by two daughters, three sons and a brother: Mrs. Terry McKean, 80 Ashbury street; Mrs. L. E. Wood, Naglee Park; Albert J.Battee of Berkeley; Fred Battee, of Los Gatos; Phillip S. Battee of Lodi, and Samuel Battee of Portand. His parents, Elisha and Jemima Battie, with their four eldest sons, emigrated to Ohio about September, 1835, locating near Hebron. Elisha, Sr., was born January 31, 1798, and died May 31, 1866; Jemima, his wife, was born February 5, 1805, in sight of Bunker Hill monument. Her maiden name was Jemima Stansberry. At eighteen years of age the subject of this sketch began his present trade, at which he has continued nearly all of his time. He was employed by the Government during the fall and winter of 1862 and spring of 1863, building boats at Bridgeport, Alabama. He worked at his trade in Cedar county, Iowa, Berlin, Wisconsin, and Fort Scott, Kansas. He married Hellen Gregory; November 15, 1866, who was born December 18, 1846, in Monroe township, near Johnstown. Her parents, Madison and Sarah Gregory, were born, the former in Maryland, the latter in Virginia. They emigrated to Licking county in an early day, locating near Utica. Battee. Do you know if her full name is Mary Malissa Battee? I have a Malissa M. Battee married to Franklin Allen in Licking County 24 Jan 1886. Frank is a brother to my gggrandmother, Clarissa Allen. The 1900 Census lists Frank and Malissa in Pataskala, Ohio. Her birth date is given as Apr 1844. On Frank's death certificate (1919), his wife is listed as Mary Allen. I think this is Mary Malissa. Do you know any more about her? Elisha Battee is the only Battee family in Licking County for 1860, 1870, and 1880, so I think she must belong to your Elisha and Jemima. I found Elisha in the Grantee-Grantor Index as buying land in Licking Co. in 1835-36. Do you know where he was in 1840 and 1850? I couldn't find him in Alexandria in 1840, or 1850, on the Census.
