Last Will and Testament
IN THE NAME OF THE BENEVOLENT FATHER OF ALL, AMEN:
I, Joseph Rutherford, Sr. of the township of Center County of Noble, and State of Ohio, being about eighty-four years of age, and being of sound and disposing mind and memory, Do Make, Publish and Declare this my LAST WILL AND TESTAMENT, hereby revoking and making null and void all other last Wills and Testament by me made heretofore;
FIRST: My will is that all my just debts and funeral expenses shall be paid out of my Estate as soon after my decease as shall be found convenient. Also a suitable monument for myself and wife.
SECOND: I give, devise and bequeath to my wife Caroline Rutherford all my real and personal property during her natural life time.
THIRD: All my sons and duaghters are to share equal in my estate except Ethel which she is to receive One Hundred Dollars more than her equal share.
FOUTH: I nominate and appoint H. N. Rutherford and J. G. Rutherford to be the executors of this will.
In testimoney whereof, I have herunto set my hand to this, my last will and testament, at my residence, this 13 day of February, in the year of our Lord, one thousand nine hundred and fourteen.

Becky, did you get my picture of George Washington Brown? Since he and his wife, Mary Ann Shafer, both lived into the 1890's, and since a photo was taken of him, it seems to me there should be one somewhere of her, too. That wasn't so long ago.

The following is not about the Shafers, but I'll include it here. In a xeroxed copy of a letter to my Aunt Angie (Cleary) Pigg, on November 29, 1946 (gad, today is Nov 29), "Aunt Ethel" Rutherford wrote, "And about my Dad's people I don't know much either. My grandfather R came from Ireland, he and his three sisters. One sister ws Mary Davison Carter's grandmother and one was Ann Jackson. Whether James Beatty's wife was a Jackson or Rutherford, I don't know which it was. But I do know we are related to the Beatty's on Dad's side anyway. Ma has a lot of relatives too at Mt Ephraim. My grandfather married in York State (New York now). Her name was Ann McCan. I know Uncle John, a joiner, was born in York State as he always called it. And there was Aunt Mary Ann Rutherford Younglue, and Joseph R, a farmer (my father), Robert Rutherford, veteran of the Civil War, Samuel R - was a cook in the Civil War. He couldn't fight as he was a cripple from a white swelling when a child. James R was in the Civil War but never came home. Whether he was killed in action they never knew, but anyway they never heard from him. William R died when a young boy from flux as also did my grandfather and grandmother. All died close together I don't know how far apart but the same summer, or fall, I don't know which. I have heard Uncle John talk about it. Uncle Sam had 2 daughters and a son. Uncle has been dead a long time. His son and wife and little son ere at our home once. Uncle Sam's second wife was along. Uncle Sam lived at Chilicothe, O. He kept a tavern for ears, (?) owned several houses in C. One of the daughters did live in cleveland, O. Uncle John had one son to live. He died long ago but his children are around --well or Marietta. Aunt Mary Ann never had any chldren. She lived and died in Vinton County. END
PS, I looked up Pittstown on an Old NY names website, and Pittstown is the former name of Richmond. Only problem: I didn't find a Richmond on the map. Anne

Grandfather Rutherford's name was Joseph, Sr. Grandmother was Carolyn Brown. They had 10 children, 6 girls and 4 boys. They were James, George, Tilley, Mary Ann, my mother and your grandmother. Arabella, Emma, Law, Hiram, Joe and Ethel. She was the youngest, about Uncle Ed's (my Uncle Ed, Kyle's brother) age.
They lived close to a small town, East Union. Some people called it Bragadoci(?).
To get to their home you had to go up a lane. You had to go through 4 or 5 gates, then up a large hill. We used to go there with horse and buggy (I guess you know what that was). They had a real nice spring of water.
Grandmother R was a good cook. She always had chicken. They always had 2 or 3 cows, and enough chickens for their eggs. They raised their own hogs for their pork. Every since I remember Grandpa was hard of hearing and pretty crippled. His byword was good-a-mighty. He used to come visit us. Always came on horse back (Old Maud). He was a little different than the grandpa's of today.
He came to visit us one time. When he went home they asked if there was anything new. We had an organ. He said the girls played the dulcimer all the time. He didn't have a lot of education. People couldn't cheat him in a deal. They were Scotch Irish. That picture [portraits of J and Caroline now on Becky's website] looks a lot like them, but younger than when I knew them. Some say if it wasn't for the beard I would look like him.
I think G.P was 70 some when he died and G.M. probably in the 80s. there was a lot of big sandstone on their place.

Aunt Mary (Cleary) Hunter wrote: "I stayed with my grandmother Rutherford often. They only lived eight or ten miles from us, but in the days of horse and buggy that was quite a distance. Grandmother was a very jolly lady and loved to tease. When I was with them she always gave me what I liked to eat. This also was a large family - four sons and six daughters. However, we never knew them as well as the Cleary kin. Grandfather always said he was from York State, meaning, I think, New York. He walked with a cane when I knew him, was deaf, had what he called "rheumatiz" and also poor eyesight. This led Angie to say when some of these afflictions caught up with her that her Grandfather Rutherford ruined her."
