Company F was enrolled at Mt Ida, a village in the hills of Montgomery County, Arkansas. These men marched out of Mt Ida July 17th, 1861 as towns people played homemade drums and fifes. They had no idea the war would last as long as it did and take such a large toll of their lives. Their baggage consisted of homemade quilts, pots and pans and an assortment of rifles, mostly flintlocks, squirrel guns and a few double barrel shotguns. The supplies being loaded in wagons drawn by teams of oxen.

The tradition of Cherokee ancestry runs strong in my family. As the story is passed to successive generations, one question is invaribly asked. How much Indian are we? And who wouldn't desire to travel backwards eighty-seven years in time to interview a knowledgable ancestor? This paper will assist the reader locate documents that answer many questions we'd ask. The quantity of genealogical data in these records is impressive.

The first treaty by which Indians ceded land east of the Mississippi River in exchange for land to the west was that of July 8, 1817, with the Cherokee Nation. The major Cherokee removal, however, did not come until after the treaty of December 29, 1835. 1)

This treaty culminated in the infamous Trail of Tears. Heeding their Chief's order most of the Cherokee refused to participate in the official 1835 census. Now called the Henderson Roll, it included an enumeration of stock and other property for which payment was due as a consideration for relocation. Passive resistance was forcibly met by an enraged Georgia militia escorting the federal census takers. Despite the pressure, fewer than 500 of the more than 17,000 Cherokee appeared at the New Echota conference. The treaty of December 29, 1835 bore one hundred odd Cherokee signatures representing, at most, consent by less than a twentieth of the Cherokee Nation. 2) Lastly a memorial dated February 22, 1838 and signed by 15,665 of the Cherokee people repudiating the treaty was presented to the 25th Congress. 3) An official compilation of this document appears in the U.S. Serial Set but it bears only eight signatures. 4) Scrutiny of the orginal signature list is a research topic worthy of it's own merit.

Correspondence from the Center for Legislative Archives of the National Archives, Washington, DC indicates a rolled petition is undergoing conservation treatment and unavailable for public inspection at this time. It was submitted to the U.S. Senate (Record Group 46) and does contain a list of 15,000 names relating to the Treaty of New Echota (24th Congress, 1st Session). This record is not indexed.

The U.S. Court of Claims was established by an act of February 24, 1885 (10 Stat. 612) to hear claims against the United States including those referred to the court by Congress. An act approved July 1, 1902 (32 Stat. 726), gave the Court of Claims jurisdiction over any claim arising under treaty stipulations that the Cherokee Tribe, or any band thereof, might have against the United States. Within 2 years after the act was approved, three suits were brought before the court concerning grievances arising out of the treaties: (1) The Chreokee Nation v. The United States, General Jurisdiction Case No. 23199; (2) The Eastern and Emmigrant Cherokees v. The United States, General Jurisdiction Case No. 23212; (3) The Eastern Cherokees v. The United States, General Jurisdiction Case No. 23214. On May 18, 1905, the court decided in favor of the Eastern Cherokee and instructed the Secretary of the Interior to identify the persons entitled to participate in the distribution of funds for payment of the claims. On June 30, 1906, Congress appropriated more than $1 million for this purpose. Guion Miller, special agent of the Interior Department, began compiling a roll of all Eastern and Western Cherokee Indians who were alive on May 28, 1906, and could establish that at the time of the treaties they were members or descendants of members of the Eastern Cherokee. They also had to prove that they had not been affiliated with any tribe of Indians other than the Eastern Cherokee or the Cherokee Nation. In his report of May 28, 1909, Miller stated that 45,847 separate applications had been filed,

representing a total of about 90,000 individual claimants, 30,254 of whom were entitled to share in the fund. 5)

The Eastern Cherokee Applications to the U.S. Court of Claims, 1906-1909 (M1104. 348 rolls) contain sworn evidences of identity. The application required each claimant to state fully his or her English and Indian names, residence, age, place of birth, name of husband or wife, name of tribe, and names of children. It further required the English and Indian names of the claimant's parents and grandparents, place of their birth, place of their residence in 1851 if they were living at the time, dates of their death, and a statement as to whether any of them had ever before been enrolled as Indians for annuities or other benefits and, if so, with what tribe. Each claimant was also to furnish the names of all brothers and sisters, with their ages and residences, and the names of all uncles and aunts. Applications were required to be made under oath and to be supported by affidavits of two witnesses who were well acquainted with the applicant. The applications are arranged by the number assigned at the time the application was received. 6) The index to the applications is arranged alphabetically by name (either English or Indian) of claimant. 7)

My great-great grandmother, #45149 Icy Catharine Ruff, and all 194 other applicants of this family were rejected by special agent Guion Miller's commission. This is because each of the four Biddy siblings they claimed descent from was not listed in the 1835 Henderson roll, the Chapman, Drennen and Old Settler Rolls of 1851 nor the Hester Roll of 1884.

In certifying the eligibility of the Cherokee, Miller used earlier census lists and rolls that had been made of the Cherokee between 1835 and 1884. 8)

They were enumerated in the U.S. census records primarily as whites. However, from the significant number that applied, it is evident they claimed Cherokee ancestry. The 1860 census of Polk County, NC 9) lists the race of Robert Johnson Biddy, Icy Catharine Ruff's father, as Indian. The 1850 census of Rutherford County, NC 10) states he and five children are of mixed-blood.

Information provided in these records pinpoint the Biddy family orginating in Union County, SC. One applicant states they lived nearby the old iron works where Glendale Cotton Mill, near Spartanburg, SC, is presently located. They migrated to Rutherford County, NC before 1820 and thence to Tennessee, Georgia, Alabama, Arkansas, Oklahoma and Texas.

The only place any Biddy family can be found in the First Census of the United States 1790 11) is at Union County, Ninety-Six District, SC. They were enumerated as whites during that decade. Probably one of the heads of the household, Thomas or Peter, is my ancestor. It is interesting to note that my great-great-great-great grandfather, Edmond Biddy, and family (except his spouse) are categorized as "all others, except Indians not taxed" in the 1800 census of Union County, SC. 12) During 1810 13) all are enumerated as whites except Edmond is listed as a "free person of color". The 1820 census of Rutherford County, NC 14) lists every person in Edmond Biddy's household as white.

Regiment of the SC line during the Revolutionary War. All of these appear in the 1800 census of Union County, SC and, except Peter, were undoubtedly part of Thomas Biddy's household in 1790.

John Biddy applied for a pension 16) on October 3, 1832. Aged 70, he states he was born July 17, 1762 in Lunenburgh County, VA. He died October 14, 1841 in Marshall County, AL and afterwards his widow, Sarah, filed an application for his pension arrears. 17) This family was enumerated under his son, James Biddy, as head of the household in the 1840 census of Marshall County, AL. 18) James, possibly a female sibling, and his father, John Biddy, were counted as "free colored persons" while the remainder are listed as white. All of the family members are enumerated as white in the 1850 census of Marshall County, AL. 19)

Are the Biddys of Cherokee descent? I have no irrefutable proof, and the search continues. 195 family members recorded below believed such. Early census reports evidence recognition of mixed-blood or of the caucasion race. And there's four patriots of the Revolution plus numerous family members who later fought for the Confederate States of America.

Rutherford Co., North Carolina was created in 1779 from the larger
Burke & the old Tryon County. It consisted of all the area west of
the old Mecklenburge Co. and "west" to the present state boundary.
In 1778, Lincoln was created from the old Tryon Co.
In 1779, part of Rutherford was created from Rowan & Tryon was discon't.
In 1791, part of Buncumbe was created from, Burke & Rutherford
In 1841, Cleveland was created from part of Lincoln & Rutherford
In 1842, McDowell was created from part of Burke & Rutherford.
In 1855, Polk was created from part of Henderson & Rutherford.
