In the name of God Amen. I William Hudspeth of the
county of Wilkes and state of Georgia being far advanced in years but of sound
and disposing mind and memory thanks be to Almighty God for the same and
calling to mind the uncertainty of Life do make and Ordain this my last will
& Testament in manner and form following
And first of all I comment my soul to God trusting that through his infinate
mercy and Goodness and the blessings of of my offering Redeemer Enterceding for
me at the throne of grace I shall receive Everlasting life and Salvation. My
body I request to be decently Entered at the discretion of my Executors
hereafter named Touchey (sic). My Worldly Estate I dispose of in the following
manner.
First my will and desire is that there be no division of my Estate until my
Just debts are all paid --
Item. I lend to my wife Mary Hudspeth during her natural life the plantation
whereon I now live including three Hundred acres of Land & five Slaves.
Viz. Stephen, Andres, Iam, Sam and Grace and also all my stock and Household
and Kitchen Furniture Except what may herein after be disposed of Otherwise.
Item. I give and bequeath to my son Robert Hudspeth one negro woman named Grace
after the decease of my wife and One Negro woman named Phoe also a Bond for
sixty-five Pounds given by Stephen Lyons now in his possession to collect.
Item. I give and bequeath to my daughter Mary Lawrence two Slaves viz. Stephen
& Pink Stephen to be taken at the death of my wife to Pinkalay term
Item. I give and bequeath to my son Thomas Hudspeth two Hundred acres of Land
Joining Joel Appling also Two Negroes Jacob & Milly and one Negro called
Andrew after my wifes decease
Item. I give and bequeath to my son George Hudspeth two negroes Isaac and Vodel
also one negro called Sam after the decease of my wife
Item. I give and bequeath to my son Richard Hudspeth Four negroes Viz. One man
called Brink one boy called Napier one girl called Rose & one other called
Lilly also Three Hundred acres of Land lent to my Wife also one negro boy
called Iam after the decease of my Wife
Item. I give and bequeath to my Grand daughter Tabitha Lawrence One negro Girl
named Maca & One feather Bed and Furniture.
Item. I give and bequeath to my Grandson George Lawrence One negro Boy named
Lewis
Item. It is also my will and desire that after the decease of my Wife that all
the residue of my House hold & Kitchen furniture and also all my stock of
what kindsoever be Equally divided among all my childrren Viz. Robert Hudspeth
Mary Lawrence George Hudspeth Thomas Hudspeth & Richard Hudspeth
Lastly I do hereby nominate constitute and appoint my friends John Hanson &
Thomas Terrell ____ & my son George Hudspeth my Whole and Sole Executors of
this my last Will and Testament And I do Hereby revoke all former Wills
heretofore made by me In witness whereof I have hereunto set my seal this 13th
day August A.D. 1802

Roly two of the subscribing witnesses to the foregoing will and being duly
sworn saith that they saw the within named Wm Hudspeth sign seal publish and
declare the above instrument of Writing to be his last Will and Testament and
that at the time of his sodoing he was of sound and disposing mind and memory
and that Harris Coleman and Isaac McKleroy subscribed
as concurring Evidences To the same.
