She was born December 03, 1828 in Jefferson County, Tennessee, and died July 14, 1895 in Point Pleasant, Cocke County, Tennessee.

James Overholt if found in the Jefferson County, Tennessee 1850 Census, as a laborer in the James Hale family.

James Overholt is found in the Jefferson County, Tennessee Census of 1860. He was listed as Jas age 29, wife Jane 35, Geo 8, E.J. 6 (f), Newt. 5, John 3. #107-382.

James served as a Private from January 3, 1863- August 2, 1865 in Company "D", 4th Tenn. Reg. Inf. Union, for which he received a pension.

A letter for the Department of Interior, Bureau of Pensions, dated April 9, 1891 stated:
"Sir:
Enclosed herein is a Certificate No. 398.429 for Addl. pension, this day issued in your favor.
The Pension Agent at Knoxville, upon whose rolls your name is to be inscribed, will forward to you properly prepared vouchers, and, when these shall have been duly executed and returned to him, will transmit, directly to your address a check for the pension then due.
Your recognized attorney is E.W. Humgate of White Pine, Tennessee, whose fee is 10 dollars which is payable by the Pension Agent.

SIR:
By reference of the U.S. Pension Agent at Knoxville, Tennessee, I have to acknowledge the receipt on the 1st instant of your letter of the 26th ultimo, in which you state that you are afraid that you have not attained the age of 75 years in the case certificate 398429, as late private, Co "D", 4th Tenn. Volunteer Infantry, act of February 6, 1907.
In response you are advised the the U.S.Pension Agent at Knoxville, Tennessee, has this day been advised that the evidence in your case, showed that you were over 75 years of age, and upon receipt of the pension certificate, together with a voucher for the pension due under said act, you should execute the voucher without hesitancy.

The LAST WILL AND TESTAMENT OF JAMES WILEY OVERHOLT was admitted to probate January 30, 1912 as a lost will, J.M. Fox being a subscribing witness.
"... I dispose of my property both real and personal.

FIRST, to my son Newton S. Overholt and my daughter Elizabeth Phillip, (Formerly Overholt) the Home farm ... for further description I refer to the ... Joseph Fowler to me, now in my possession, ... to take effect at my death.

I have already executed a deed to my grand children Christian Smith, Nancy Samples, Noah Smith for a certain tract of land known as the Ramsey place bought of George Inman executors I design that as their part of my real estate.

I have also executed deeds to my son David Overholt for two tracts of land known as the Driskill ... This I design as his part of my real estate, of my personal property I have given to John Overholt, my son, Thirteen Hundred $1300.00 Dollars in money in lieu of his part of my real estate.

I give to my Daughter Elizabeth Phillip all of my personal property in my possession at the time of my death, Two hundred fifty $250.00 Dollars extra and above the others of ... for service rendered to me in ... and sickness. I also give to her one black mare and colt, one years provisions, all the kitchen, farm, ... poultry, two plows, and gears for two horses.

I desire and will that all my personal property in my possession at the time of my death not mentioned above be equally divided among my heirs after paying all just debts and toward expenses.

The remainder of the Ramsey farm about thirteen acres which is not included in the deeds executed to my grandchildren Christian Smith, Nancy Samples, and Noah Smith ... said property by this my will

I hereby appoint my Son Newton S. Overholt executor and excuse him of bond. This January 3, 1912.

He says he had neither brother nor sister, and he writes, "My father died about the time I was born and my mother died when I was very small. I met Joseph Overhultz in 1863 and he told me he was my father's brother."
