Peacock versus Spooner. After hearing Counsel, at the Bar, the Fifteenth Instant, upon the Petition and Appeal of Thomas Peacock; from a Decree made by the Lords Commissioners of the Great Seal, upon Re-hearing of a Cause wherein Henry Spooner and Mary his Wife, Samuell Smith and Elizabeth his Wife, and Thomas Freeman and Frances his Wife, and Mary Smith, and Thomas Wheeler, and their Consederates, were Plaintiffs, and the Petitioner Defendant; as also upon the Answer of Henry Spooner and Mary his Wife, Samuell Smith and Elizabeth his Wife, Thomas Freeman and Frances his Wife, and Mary Smith Widow, and Thomas Wheeler, put in to the said Petition: After due Consideration had of what was offered by Counsel upon the said Petition and Answer, it is this Day ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of the said Thomas Peacock shall be, and is hereby, dismissed this House; and that the Decree complained of in the said Petition shall be, and is hereby, affirmed.

Woodhouse to be attached, for arresting Peacock, Ld. Howard's Servant. Upon Oath made this Day at the Bar, "That Thomas Woodhouse Bailiff did arrest Thomas Peacock, menial Servant to the Lord Howard of Escreck, a Peer of this Realm, contrary to the Privilege of Peerage and Privilege of Parliament:" It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Gentleman Usher of the Black Rod attending this House do take into his Custody the Body of the said Thomas Woodhouse, and keep him in safe Custody for his said Offence; and this shall be a sufficient Warrant on that Behalf. To Sir Tho. Duppa, Gentleman Usher of the Black Rod, his Deputy and Deputies, and every of them.

Peacock, L. Howard's Servant, arrested. The House being informed, "That Thomas Peacocke, menial Servant to the Lord Howard of Escrik, a Peer of this Realm, is arrested, within the Time of Privilege of Parliament, contrary to the Privilege of Parliament, by Dunning and Woodhouse, Bailiffs:" Peacock released; and Dunning and Woodhouse sent for. It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Thomas Peacock be, and is hereby, set at Liberty, if he now remains in Custody; and that Dunning and Woodhouse Bailiffs be, and are hereby, required to attend at the Bar of this House on Monday the 5th Day of May next, at Ten of the Clock in the Forenoon, as they will answer the contrary at their Peril: And this shall be a sufficient Warrant on that Behalf.
