The Last Will and Testament of David Staples of the Town of Marlborough, County of Ulster, State of New York. I, David Staples considering the uncertainty of this Mortal Life and being of sound mind and memory, Blessed be Almighty God for the same, Do make and publish this my Last Will and Testament, in the manner and form following, that is to say. First I give and bequeath to my wife Marcy Staples one bedsted and bed and bedding, also all the beds and bedding that I own during her my said wife’s natural life together with all my cooking utensils and household furniture during her natural life. I also give and bequeath to my said wife six chairs that she bought and six silver teaspoons and all the things that she brought to my house, forever, and I also order that my said wife have the use of the North Room and the North Chamber in the new part,of the new part of the house, and half of the kitchen and the milk house and the cellar and other privileges of cellar as she wants and also a privilege in the garret if she chooses during her my said wife’s natural life. And I do order my son Ira Staples to fund (?) My said wife with bread and meat and fuel for her fires and to keep two cows wither and summer and let her have the profits from them, and also to let her my said wife have the wool of six sheep during her natural life. If my said wife Marcy Staples agrees to the Will that I have made, if not, I do order that she have nothing, only what the law will allow her. I do give and bequeath unto my two Daughters, Pamely Cosman, wife of Oliver Cosman and Maria Caverly, wife of Carpenter Caverly, all of my household furniture of what kind and what nature soever, to them and their heirs forever after my said wife’s decease. Item: I do give and bequeath unto my son David Staples, Junior all of my wearing apparel of what kind and nature so ever and one large bible after my wife’s decease. Item: I do give and bequeath to my son Stephen Staples and to his heirs and assigns forever on lot of land lying on the mountain that I bought of George D Wickham, in Graham Patent, containing about 5 acres of land, on the north of land of Ira Staples and on the west by land of Stephen Staples. Item: I do give, bequeath and assign to my youngest son Ira Staples and to his heirs and assigns forever all that acreage or tenament that I bought of Thomas Wygant, the farm wherever I now live situate in the Town of Marlborough, County and State aforesaid and is bounded on the north by land formally belonging to John Bout and John Wygant and on the west by Graham Patent and on the south by lands of James Birdsall deceased and the highway that leads to Marlborough containing one hundred and sixty acres of land. Also one other piece of land adjoining the aforesaid described piece, a piece that I bought of Jeramiah Sabin, bounded on the west by land of the heirs of James Birdsall, on the south by said heirs and Jeramiah Howell and on the east by lands of Nathaniel Wygant and on the north by lands that I bought of Thomas Wygant, containing forty one acres of lands. Also one other piece of land that I bought of George D Wickham lying part in the Town of Platekill and part in the Town of Marlborough on Graham Patent known as lot #35 thirty five, bounded by lands on the west by land of the heirs of Henry Scott junior, on the south by lands of Henry Haines and Barnard Bout, on the east by lands of the heirs of John Wygant, on the north by lands of Allen Lester containing forty two acres of land. I do also give and bequeath to my son Ira Staples all of my farming utensils and all of the obligations and all debts that bare due me and all the money that I have and all of my books, that is not otherwise disposed of. And also I give and bequeath unto my son Ira Staples all of my cattle, sheep and one mare and all the rest and residue of my personal property, goods and chattle of what kind and nature so ever I give and bequeath un to my son Ira Staples and to his heirs and assigns forever. And I do hereby order that my son Ira Staples pay unto my daughter Maria Caverly, wife of Carpenter Caverly or to her heirs four hundred dollars within one year of my decease. I do also order that my son Ira Staples pay unto my daughter Pamelee Cosman, wife of Oliver Cosman four hundred dollars in the following manner, two hundred dollars within two years of my decease and the other two hundred dollars in four years of my decease, or to her heirs or assigns and I do hereby appoint my son Ira Staples Executor of this my Last Will and Testament revoking all former Wills by me made in witness thereof I have set my hand and seal the ninth day of January in the year of our Lord one thousand eight hundred and twenty eight. Signed, David Staples Signed, Sealed, Published and Declared by the above named David Staples to be his last Will and Testament in the presence of the Testator, George Birdsall, Hosea Birdsall, Eliza Ann Plumstead . Ulster County SS: Be it remembered that on the first day of June in the year of our Lord one thousand eight hundred and twenty nine personally came and appeared before me, Jonathan D Ostrander, Surrogate of the said County of Ulster, George Birdsall of Marlborough in the said County, one of the subscribing witnesses to the Will of David Staples late of the Town of Marlborough of the said county deceased, who being duly sworn declared that he did see David Staples now deceased, sign and seal the instrument hereunder annexed purporting to be his Last Will and Testament bearing the date of the ninth day of January in the year of our Lord one thousand eight hundred and twenty eight and heard him publish and declare the same as and for his Last Will and Testament and at the time thereof, he David Staples was of sound and disposing mind and memory to the best of his knowledge and belief of the said deponent and that Hosea Birdsall and Eliza Ann Plumstead, together with the deponent subscribed the said Will as witnesses thereof in the testators presence, and be it also remembered that on the day and year aforesaid personally appeared before me, the said Surrogate, Ira Staples of Marlborough, the Executor in the aforesaid Will named and was duly sworn to the faithful execution and performance of the said Will by taking the usual oath in that case provided.
