      26 April 1675. Whereas it appears that John Williams, a mulatto servant to Mr. MARTIN GARDNER, killed a hog belonging to Capt. Otho Thorpe, and was guilty of other trespasses, it is ordered that the sheriff take him in custody and give him 30 lashes on his bared shoulders until the blood come; and his master is forbidden to furnish him powder and shot or to suffer him to carry a gun.

      Page 23, 10 Oct. 1687. Thomas Dunkerton as well on behalfe of his Majestie as himselfe exhibited an information against Mr. Danll. Park for that in contempt of an Act of Assembly made 20 Oct. 1686 Parke did plant several tobacco plants on his land and plantation on Queens Creeke in Bruton Parish after the last day of June last past, to which the defendant pleaded not guilty. A jury, Tho. Fere, foreman, John Battin, William Wade, Isaack Godding, Willm: Pinkethman, Phill. Moody, Ralph Graves, Elisha Stainton, John Wooden, John Whaley, Jos. Firth, and George Browne, were sworn. Two witnesses declares that upon 18 July last they did see the defendant's Negroes on the plantation on Queenes Creeke take plants up with their hows out of one hill and put them into other hills and the evidences did call to the Negroes and told them they must not plant and that they would inform and they answered they only tooke one plant out of one hill and put them into the other hill. The defendant and Mr. William Sherwood, his attorney, pleaded that it was without his privity and consent and that hee several times forbid all his Negroes. The defendant did offer his oath that hee never gave them order to plant after the last day of June. The jury returned their verdict that they find for the defendant. The informant not being satisfied appeals to his Excellency and Councell for a rehearing on the 6th day of the next Generall Court. Mr. Hugh Owen became securytie for the appealant and Mr. MARTIN GARDNER and Mr. Joseph Ring for the respondant.

      Pages 83-84, 24 Oct. 1687. By his Excellency: His Majesty by his royal predecessors impowered the Governor to grant tracts of land to the adventurers and planters upon the payment of five shillings sterling money as the annual rent for every hundred acres. His Majesty hath been pleased to comand that an exact account bee taken of all land granted for the collecting of all his quit rents. I, Francis, Lord Howard of Effingham, require you Mr. MARTIN GARDNER, his Majesties High Sherriffe for the County of York, to collect from all the inhabitants of the County of York one yeares quitt rent, the anuall rent of two shillings sterling. But for as much as many of the inhabitants of Virginia by reason of the scarcity of sterling money have not the meanes to pay in money, you are hereby permitted to accept in leiue thereof well conditioned tobacco att one penny per pound which you are required to pay to Mr. Auditor Bacon before 10 January next and to produce unto Mr. Auditor Bacon on the 3d day of the next Generall Court att James Towne a role of all lands held of our Sovereigne Lord the King and of all lands in the county for which you can find noe actuall possessor.

      Page 199, 24 Jan. 1688/89. Itt is ordered that Mr. Humphry Moody, Mr. Phill: Moody, Mr. John Underhill and Mr. Robert Dobbs inventory and appraise the estate of Xopher Hurt on 14 February next. The appraisers are to leave out the cattle due to Ann Evans, orphan, and alsoe a bed, pott and frying pann for the deceased's relict as shee did relinquish all her dower and right of administration. After the appraisement made, the securyties for the orphan's estate take out soe much of Hurt's estate as shall amount to the summe due to the orphan and the remainder of the estate to be held by Mr. MARTIN GARDNER as trustee to the Court for the estate att publick outcry for next yeares pay in tobacco to be paid convenient in York County on 14 February next, for which judgment is to bee confest by the purchaser with one county securytie to Mr. MARTIN GARDNER as trustee before Mr. Thomas Barbar and Mr. Joseph Ring whoe are desired to be present. Further ordered that GARDNER returne a full inventory of the same.

William Townson obtained an order against the Sherriff att the last Court for the nonappearance of Robert Perryman and now Perryman not appearing att this Court, the order is confirmed, and ordered that Mr. MARTIN GARDNER, Sherriff, doe pay Townsend 340 pounds of tobacco.

      Pages 441-442, 17 April 1689. Henry Tyler and John Tyler complain against MARTIN GARDNER Gent. as marrying ANN TYLER, Widdow, deceased, in an action of the case, for that ANNE by deed 24 June 1672 did grant unto her three sons Henry and John, the now plaintiffs, and Daniel each four cowes, a feather bedd and furniture of the value of £10 sterling and four pewter dishes to bee delivered at their severall ages of twenty one yeares, and in case of the death of any one of them then to the survivors, as by deed acknowledged in York County Court may appear, soone after which the defendant married ANNE, mother of the plaintiffs. Daniell, brother of the plaintiffs, was unhappily taken by the Turkes and carryed into Algier and hath not for at least seaven yeares past beene heard of, soe that hee is by law esteemed dead, whereby that which was given to Daniell by the deed is of right due to the plaintiffs as the survivors. They pray delivery of four cowes, a bed and furniture of £10 sterling value and four pewter dishes. Itt's ordered that MARTIN GARDNER deliver the bed and furniture of £10 sterling value and four pewter dishes to Henry Tyler and John Tyler in October next and the cattle in April next following and that Henry Tyler and John Tyler doe att the next Court held for York County after the receipt of the bed and furniture, dishes and cattle, give good security to repay to Daniell Tyler if ever hee returns.

      Pages 127-129. Will of Francis Page of Middle Plantation in Yorke County, Gent., being sick of body, dated 20 April 1692.
      To be buryed according to the rites and ceremonies of the Church of England in the Churchyard att Middle Plantation as near and att as a convenient distance from my late dear wife's grave as may be for laying of a gravestone over each of our graves, the ordering whereof and of my funerall I leave to the discretion of my honored mother Mrs. Alice Page and my dear and loveing brother Capt. Matthew Page, and itt is my desire that over my grave erected with brick of equall highth with my dear father's and wife's graves there be laid a pollisht black marble stone.
      I well knowing the intent of my late deceased father John Page, Esqr., was to give to my cozen John Page, son of my unkle Robert Page, the plantation called Muskimino, doe not only to performe the desire of my father but alsoe for love and affection give him all that plantation called Muskimino containing 790 acres att or near Chickahominy, 300 acres, part thereof, lying in James Citty County being purchased of my father of Christopher Chant, and the other 490 acres lying in New Kent County purchased by my father, part of Robert Booth and the other part of John Boswell, son and heir of David Boswell.
      I have (as one of the executors of my father) a right to the third parte of the Negroes, stock and other personall estate on the said plantation. I give to my cusen John Page the use of my part of all servants, Negroes, cattle, stock, goods and chattells on the plantation called Muskimino. If my cusen John Page dye without haveing issue of his body lawfully begotten then the same to revert to my right heire.
      To my dear and only child Elizabeth Page all my estate. I comitt her to the care, tuition and government of my honored mother and after the decease of my mother of my well beloved brother in law Mr. Dudley Diggs whoe I desire to bestow on my child the best education this country can afford. I appoint that my executors employ my Negroes' labour and cropps with any other part of my personall estate to the best advantage of my daughter by settling another quarter on my land called Pampertike in King and Queen County and purchasing more Negroes to be settled thereon and on my other plantations and quarters.
      My daughter on the day of her marriage (in which I charge her to take the advice of her grandmother and two unkles my executors and their consents) £200 sterling besides that part of her grandmother Mrs. Eliza: Diggs' estate which is due her and the other part of my daughter's estate to be paid her att her age of one and twenty years.
      I desire my executors to take care that my brick mault house and brick barne with all other my houses att Middle Plantation be finished and kept in good repaire and the same be leased till my daughter come to age of one and twenty years.
      All my reall estate, houses, lands and plantations to be held by my daughter and her heirs forever, and for want of issue to my brother Matthew Page.
      I desire my brother Dudley Diggs that he take the trouble on him to settle for my child that part of the estate belonging to her out of the estate of her grandmother Mrs. Eliz: Diggs.
      To a poor man that lives on the Queen's Hill in Pomankey Neck (whose name I cannot well remember but is well knowne to my brother Matthew Page) £5 sterling to be laid out by my brother for the best advantage of the poor man.
      To Evan Roberts of Mill Swamp in Bruton Parish £5 sterling to be laid out by Mr. Samuell Timson for the best advantage of Evan.
      To each of my executors £20 sterling to buy them and their wives mourning.
      I give mourning rings to the severall persons hereafter named, William Cole Esqr. and his wife, Willm. Diggs Esqr. and his wife, my loveing brother Matthew Page and his wife, and Mr. Dudley Diggs and his wife, Edmond Jenings Esqr. and his wife, William Sherwood and his wife, Mr. Dannll. Parke and his wife, Mr. Samll. Timson and his wife, my cussens Tyler and his wife, and John Page, Mrs. Mary Jones, Mr. Samuell Eborne and his wife, Mr. MARTIN GARDNER, Mr. Thomas Thorpe and his wife and Capt. James Archer.
      To my loveing friend Willm. Sherwood £5 sterling for writeing this my will.
      My dear and loveing brother Capt. Matthew Page and Mr. Dudley Diggs executors.
