      To John R. Ballard: Greetings whereas, in and by a decree of the Judge of said Court, rendered on the 30th day of August 1898, you were appointed by said Judge, Commissioner to sell the following described lands or real estate situated in this County, to wit: the West ½ of Sec. (27) twenty seven and the East ½ of the N.E. ¼ and the N.E. ¼ of the S.E. ¼ of Sec. (33) thirty three all in Township 22 Range 21 in Tallapoosa County, Alabama, which property is held and owned jointly, equally and in common by: J.D. TAUNTON, J.A.D. TAUNTON, A.J. TAUNTON, F.M. TAUNTON, G.P. TAUNTON, Mrs. MARTHA A. LOTT, Mrs. MANDY DEAN, Mrs. ELLEN SPEAKS, E.O. TAUNTON. Now therefore you are hereby directed in pursuance of said decree, and the statute in such cases made and provided, to sell the above described real estate to the highest bidder for cash, at public auction on the premises on the 17th day of Sept. 1898. Known as the Old Homestead in this County for the purpose of making an equitable partition and division between the said Joint Owners after first giving at least three weeks notice of the time, place and terms of sale together with a description of said property by advertisement to be inserted in the Spot Cash, a newspaper published in the County, and you are hereby further directed to make return to said Court in writing under oath of your proceedings in this behalf within thirty days after said sale.       SAMUEL L. DEAN received a 40 acre land grant on 2 December 1853, S27-T22-R21E, west of Highway 63 and south of his father's land. On 1 January 1854, he received 40 acres, S22-T221E. He enlisted in the Confederate Army on 9 April 1862 at Lochapolka [Alabama]. He served with Company C of the 47th Alabama Infantry Regiment, under Captain J.T. Russel. By August of that year they joined Stonewall Jackson's Brigade in Northern Virginia. On August 31 his military records list him as hospitalized at Winchester, VA. Eight months later, April 1863, he was hospitalized at Danville, VA, which may have lasted through July. Later that year he was allowed home to recuperate from "Ascites." By October he returned to his unit and on 10 February 1864 he was captured at Morristown, TN. The war ended in April, and after taking an allegiance to the union, he was allowed to return home. Family folklore has it, either during the furlough or after the war, when he returned home he found his wife with another man. He left never to return, first traveling to Kentucky, then Arkansas. While travelling down the Mississippi river it is believed he married a second wife.

      The State of Alabama, Tallapoosa County. Be it known that for value received and in consideration of the payment of Sixty five dollars by A.G. Campbell & Co., I F.M. TANTON of Tallapoosa County, Alabama, have this day bargained and sold, and do hereby bargain, sell, and agree to deliver to said A.G. Campbell & Co. Five hundred and sixteen pounds of lint cotton of middling quality of the present growing crop to be made by me in said County, to be delivered in good merchantable order at my own expense to said A.G. Campbell & Co. or their assigns on or before the fifteenth day of October 1870 in the city of Wetumpka. And it is hereby expressly agreed that if the said cotton, or any part thereof, shall not be delivered on the day herein before specified for its delivery, then the measure of the damages shall be the best price of such cotton on that day or any subsequent day until the full satisfaction and discharge of this instrument. The said sale is made by me bona fide for the purpose of obtaining money to make a crop, and without such aid it would not be in my power to procure the necessary teams, provisions and farming implements to make a crop. And the better to secure the said A.G. Campbell & Co. against all loss or damage by reason of any failure to comply with or to execcute this contract, I, F.M. TANTON of said County, in consideration aforesaid do hereby bargain, sell and convey to said A.G. Campbell & Co. the following described property, all of which is free from encumbrance, to wit: One bay mule and my entire crop of 1870, Three cows & calves & two Yearlings. To have and to hold the same to themselves or their assigns, or legal representatives, in trust, for the following purposes, viz: That is to say, that in the event the said F.M. TANTON shall fail or neglect or refuse to deliver said cotton in quantity quality and condition as herein stipulated, and at the time and place aforesaid, then and in that case A.G. Campbell & Co. or their agents or assigns are hereby authorized and empowered to sell said property or real estate hereby conveyed at public auction for cash in hand at Wetumpka, first giving twenty days notice of the time, terms and place of sale, by publication in some newspaper published in Wetumpka and upon such sale to make full and complete title to the purchaser of said property and apply the proceeds to the payment of such amount as may be due by reason of a breach of this contract, together with the expenses of this trust, hereby waiving the statutory right of redemption, and any delay or advantage given by law postponing or delaying the right of foreclosure. But should this contract be complied with fully, then and in that case this conveyance to be null and void, otherwise to remain in full force and effect.       The State of Alabama, Tallapoosa County. Be it known that for value received and in $53.00 by A.G. Campbell & Co. we F.M. TANTON and HENRY TANTON of Tallapoosa County, Ala., have this day bargained and sold, and do hereby bargain, sell and agree to deliver to said A.G. Campbell & Co. six hundred and sixty three pounds of Lint Cotton, of middling quality, of the growing crop of 1871 to be made by me in said County, to be delivered in good merchantable order, at my own expense, to said A.G. Campbell & Co. or their assigns out of the fi__h Cotton picked and packed, on or before the 15th day of October next, at the City of Wetumpka; and it is hereby expressly agreed That if the said Cotton, or any part thereof, shall not be delivered on the day herein before specified for its delivery, then the ______ of the damages shall be the best price of Cotton on that day or any ___ ____ day, until the full satisfaction and discharge of the instruments.       To John R. Ballard: Greetings whereas, in and by a decree of the Judge of said Court, rendered on the 30th day of August 1898, you were appointed by said Judge, Commissioner to sell the following described lands or real estate situated in this County, to wit: the West ½ of Sec. (27) twenty seven and the East ½ of the N.E. ¼ and the N.E. ¼ of the S.E. ¼ of Sec. (33) thirty three all in Township 22 Range 21 in Tallapoosa County, Alabama, which property is held and owned jointly, equally and in common by: J.D. TAUNTON, J.A.D. TAUNTON, A.J. TAUNTON, F.M. TAUNTON, G.P. TAUNTON, Mrs. MARTHA A. LOTT, Mrs. MANDY DEAN, Mrs. ELLEN SPEAKS, E.O. TAUNTON. Now therefore you are hereby directed in pursuance of said decree, and the statute in such cases made and provided, to sell the above described real estate to the highest bidder for cash, at public auction on the premises on the 17th day of Sept. 1898. Known as the Old Homestead in this County for the purpose of making an equitable partition and division between the said Joint Owners after first giving at least three weeks notice of the time, place and terms of sale together with a description of said property by advertisement to be inserted in the Spot Cash, a newspaper published in the County, and you are hereby further directed to make return to said Court in writing under oath of your proceedings in this behalf within thirty days after said sale. You are further directed to turn over the proceeds of said sale until such sale shall be duly confirmed and until the further order of Court.
