HENRY TAUNTON's Will. The State of Alabama, Tallapoosa County.
I HENRY TAUNTON of the County and State aforesaid being of sound mind and memory do make ordain and this to be my last will and testament that is to say after the payment of all my just and lawful debts is paid if any there be I give the remainder of my estate to my beloved wife ELENDER TAUNTON both real and personal and monied for and during her lifetime and at her death and thereafter while the youngest child becomes of age, it to be kept together under an executor hereinafter provided and appointed, and at her death if all the children are of age, if not as even threafter as they are of age then my property to be disposed of as follows to wit: I give my son Z.C. TAUNTON five dollars, to my son MARTIN TAUNTON five dollars, to my son SAMUEL TAUNTON five dollars, to my son MORGAN TAUNTON five dollars, to my daughter CATEY WATKINS five dollars, and after my death of my wife if she survives me and the youngest child is of age the remainder of my property to be divided as follows to wit: it is to be _____ into five equal shares provided no more of my children returns home that is now absent by reason of the war in the United States, and one or more shall or may return home then in ____ case he or they shall be entitled to draw from the five shares named above a sufficient [from?] of each share to make him or them equal in share with my two daughters and I decree that my son TINSLY take care of my wife his mother for which I decree to him all the money on hand at my death for her benefit and in addition I decree to my son TINSLY TAUTON three of the five shares named above subject to the provisions made for absent children, and the other two of the five shares named above to be equally divided between my two daughters ELENDER and JULIA ANN TAUNTON to ELENDER TAUNTON I decree one of the five shares as above named, to JULIA ANN TAUNTON one of the five shares above named subject to the provisions made for absent children, and I further decree and appoint my son TINSLY TAUNTON executor to this my last will and testament. In witness whereof set my hand and affixed my seal July 8th 1865.

Know all men by these presents that we, SARAH A.E. DAILY and RUBEN DAILY her husband for and in consideration of Sixty Six Dollars and sixty six cents paid us in hand by TINSLY L. TAUNTON do hereby grant, bargain, sell and convey the following described lands to TINSLY L. TAUNTON his heirs and assigns to wit: A one twenty fourth undivided interest in the W 1/2 of the NE 1/4 and the NE 1/4 of the NE 1/4 of Sec. 10, T. 19, R. 20, and the NW 1/4 of the NW 1/4 Sec. 11, T. 19, R. 20, and SW 1/4 of the NW 1/4 of Sec. 2, T. 19, R. 20, and the NE 1/4 of the NE 1/4 of Sec. 34, T. 20, R. 20, and all that part of the SE 1/4 of the NE 1/4 as lies between the lands of Mrs. Musoura Lucker and the North line of said forty containing Ten Acres in said county and state. I am very poorly yet I think I am mending some. I can walk about a little. I can ride horse back two or three mile. I cant do no work to mount to any thing at all. Brother WILLIAM wife and child is sick and has bin all this week. They have the flu. The baby is very sick. ___ must tend to his business now we receive them papers on the 11th of July. I will send my paper back now. WILLIAM will send his as soon as his family get better. If I get able to com to see you all I will try to com. I would like to see grandmother. I believ if I was their I would be som satisfaction and pleasure for a few day. Any how tell grandmother I will try to write her a long letter after this week. I will write her all I know as near as I can. I would like the rest of them to write to me oncle. We hav just as good river land as they is I recon but poor people dont own any of it. I must tell you about crops. They are good crops in river valley and tolerable good crops in the hill country consideran late in spring and so much rain. We hav bin bless with this season. Mr. DAILEY his crop is not very good. His corn is sorry, his cotton is tolerable good on ___ I would like for you to come to see us if you can. I believ if I had live on won place like you hav I would com to Arkansas one trip and see how you like to travel and see some other portion of the country. Oncle you wrote that we need not to sign the paper if we did not want. I will sign them for I hav bin raise here and now I am sick and I hav no use for land their and you are the one to hav it if you want it. I hav no use of it their. If t was here I could sell it for a great deal more. You said we could leav the paper in the care of Brooks(?). I can leav them in the care of you. You can send the money just as well. I would hate to say that I had kind [kin] folk I could not trust. I hav lived to be 41 years old and not had it to say that I could not trust this one or that yet and hope that is the way of you for this world______ is not long. Any[way] all we need is a living... Milner and Martha A. his wife hereby acknowledge the receipt from Jesse Dobson of the sum of one hundred & forty dollars and in consideration hereof convey sell out and confirm unto the said Jesse Dobson the south East quarter of the South West quarter of Section five (5) in Township Nineteen (19) of Range Twenty one (21) East in Tallapoosa Land district subject to sale at Montgomery, Ala., to have and to hold the said premises and appertainances there to belonging to the said Jesse Dobson his heirs & assigns forever we the Sd. HENRY TANTON, R.M. To all to whom these presents shall come, Greeting: Whereas SAMUEL C. TAUNTON of Tallapoosa County, Alabama, has deposited in the General Land Office of the United States, a Certificate of the Register of the Land Office at Montgomery whereby it appears that the full payment has been made by the said SAMUEL C. TAUNTON according to the provisions of the Act of Congress of the 24th of April, 1820, entitled "An act making further provision for the sale of Public Lands," for the North Half of the North East quarter of Section 34, in Township twenty of Range twenty one, in the District of Lands subject to sale at Montgomery, Alabama, containing seventy-six acres and eighty-six hundredths of an acre, according to the official plat of the Survey of the said Lands, returned to the General Land Office by the Surveyor General, which said tract has been purchased by the said SAMUEL C. TAUNTON.
Now know ye, That the United States of America, in consideration of the premises, and in conformity with the several acts of Congress in such case made and provided, have given and granted, and by these presents do give and grant, unto the said SAMUEL C. TAUNTON and to his heirs, the said tract above described: To have and to hold the same, together with all the rights, privileges, immunities, and appurtenances, of whatsoever nature, thereunto belonging, unto the said SAMUEL C. TAUNTON and his heirs and assigns forever.
