[John L, a son by his first wife, would have been about 16 [b. 1850]. Lucinda, born 1854, was his eldest child by his second wife. The purpose of this motion for guardianship of these two children is not clear as these are his own children. Roland Brown who acts as his witness might be the father or kin of his second wife, Elizabeth Brown.]

Re: Guardians from Sandi Gorin, Glasgow, KY - SCKY List owner, researcher and historian.
"Guardians were appointed in two circumstances. (1) if the parents were dead (sometimes just the father), or (2) "ad litem" guardians. The latter was normally in a circuit court case where the parent was living but did not feel they could best represent the interests of the child in the sale or distribution of land or slaves, etc. This was a temporary guardianship. The guardianship books are found in all county clerk's offices and show the name of the guardian, those who posted surety, the child's name, age and/or dob, witnesses.
At a certain age, the child could pick their own guardian and sometimes you will find more than one guardian for a child."
