Last Will and Testament of William Adams, Sr.

 

 

I, William Adams, Sr., being of sound and disposing mind and memory and desiring in my lifetime to dispose of whatever property I may di_ seized, do hereby make and publish this my last Will and Testament, hereby revoking all former Wills by me made.

 

Item 1.  It is my desire that my just debts be first paid and I hereby direct my executor herein after named to see that said debts are first paid.  After the payment of said indebtedness, I direct that my said executor see that a suitable monument be erected at my grave, and that said monument be suitable and appropriately engraved.

 

Item 2.  After this payment of said indebtedness, I give, devise and bequeath to my son Harry Adams my home farm consisting of 165 acres, and being all the land that I now own in Section 12, Township 8 North, Range 11, West in Sullivan County, Indiana, to have and to hold the same in absolute fee simple forever.

 

Item 3.  I give, devise and bequeath to my son Charles Adams my land in Section 22, Township 8 North, Range 11 West in said Sullivan County, Indiana, to have, hold and possess the same during the period of his natural life, said land being about 160 acres.  And I give, devise and bequeath the fee of said lands, to the children of my said son Charles, subject to the said life estate therein of my said Charles, I desire that my said son Charles shall have the use, rents and profits of said lands for his own use during his said life, and that at his death the same descend in f_ _ _ _ _ his said children, if any he have at his said death.  In the event that my said son Charles shall die without children, or their descendants alive at such time, then and in such event I desire that said lands at the death of said Charles Adams shall go and descend to my son Harry, or in the event of his death prior to the death of said Charles, then to the children or descendants of children of my said son Harry.

 

Item 4.  I desire that the residue of my property, both real and personal consisting of money and all other kinds of personal property and of my real estate in Crawford County, Illinois and Marion County, Illinois, be subjected first to the payment of my first debts as set forth in Item 1.  Thereof and to the erection of said monument described in said Item 1., and after the payment of said indebtedness and for said monument.  I desire that the residue thereof be divided and descend as follows:  that the one-third of said residue after said payments go to my said son Harry in manner and to the same effect as promised in Item 2. hereof.  I desire that the one-third of said residue after the said payments above referred to go to my said son Charles to have and to hold the same in the same manner and by the same tenure and to the same effect as directed in Item 3. hereof, the remainder of said residue after the said payments, I give, devise and bequeath to the children of my deceased daughter Mary Ann Foutch, to wit Paul, William and Harry L., said children to have, hold and possess the same in absolute fee simple forever. 

 

Item 5.  I hereby nominate and appoint my son Harry Adams as executor of this my last Will and Testament, and I direct that he see that the provisions hereof be executed as above set forth.  And I desire that my said son Harry be not required to give land for the fulfillment of his duties and trust.

  In witness whereof I have here unto subscribed my name and affixed my seal at the Town of Sullivan, in Sullivan County, Indiana, this 4” day of April, A.D. 1908.
