Will of Wm. G. Adams Decd.

 

This is the last Will and Testament of me William G. Adams of Sullivan County, Indiana.  I direct all my Just debts, funeral and testamentary expenses to be paid by my Executors herein after named out of my personal Estate.

  I give and bequeath to Thomas Adams, Maria Adams, Emma Adams, Margaret Adams and Jesse Adams the children of my deceased son John Adams the sum of Three hundred Dollars each to be paid to them respectively within one year after my decease, or on their successively attaining twenty-one years of age, if any should be minors at the date of my decease.  And I hereby direct that the legacies or legacy of any or either of my said Grandchildren as may die before attaining said age of twenty-one years shall be paid to my three sons William Adams, Samuel Adams and Richard Adams as part of my residuary Estate.

  I give and bequeath to George Adams son of  my deceased son Thomas Adams the sum of One thousand dollars to be paid to him within one year after my decease, or if he is then a minor on his attaining twenty-one years of age and in case of his death before attaining said age, I direct that said sum of One thousand dollars be paid to my said sons William Adams, Samuel Adams and Richard Adams as part of my residuary Estate.  I also direct my said Executors in case any or either of my said Grandchildren above named should be minors at the time when said legacies become payable after my decease, to invest such legacies or legacy in good free hold mortgage security at interest and to pay said legacies or legacy with such interest to said legatees entitled thereto on their becoming of age, or in case of their death to said residuary legatees, in manner afore said.

All the rest, residue and remainder of my said personal Estate and all my real Estate what soever and where soever situate, I give, devise and bequeath unto and equally between my three sons William Adams, Samuel Adams and Richard Adams, their heirs, Executors, Administrators and assigns forever.  Provided however, and the bequest hereby made to my said son Samuel Adams is made on the express condition that the said Samuel Adams, shall either in my lifetime or within one year after my death, and before receiving any portion of my said Estate under this Will, release in full a certain Judgment recovered by him against me in the Sullivan Circuit Court on the 3rd of November 1881 for the sum of $1825.00 and in case of his refusal or failing so to do in manner afore said then and in that event.  I hereby give, devise and bequeath all of his share and interest in my said real and personal Estate under this Will unto and equally between my sons William Adams and Richard Adams their heirs, Executor, Administrators and Assigns forever.

  Lastly I hereby appoint my sons William Adams and Richard Adams Executors of my last Will and Testament hereby revoking all former Wills by me at any time here to fore made and declaring this to be my last.

Sullivan County                   S.S.:

                                                 Be it remembered that on the 6 day of June 1883 John T. Gunn one of the subscribing witnesses to the within and foregoing last Will and Testament of William G. Adams late of said County deceased personally appeared before me Thomas J. Mann Clerk of the Circuit Court of  Sullivan County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows:  that is to say:  That on the 16 day of June 1882 he saw the said William G. Adams sign his name to said instrument in writing as and for his last Will and Testament and that this deponent at the same time heard the said William G. Adams declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time at the request of the said William G. Adams and with his consent attested and subscribed by the said John T. Gunn and P. A. Griffith in the presence of the said Testator and in the presence of each other as subscribing witnesses there to and that the said William G. Adams was at the time of signing and subscribing of the said instrument in writing as aforesaid of full age (that is more than twenty-one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not.

Codicil

I William G. Adams of Sullivan, Indiana having made my last Will and Testament dated the 16th June 1882 do now make this Codicil to be taken as part of the same.  Where as by my said Will I have devised and bequeathed unto and equally between my three sons William Adams, Samuel Adams and Richard Adams all the rest and residue and remainder of my real and personal Estate, whatsoever.  And whereas the said Samuel Adams has since departed this life without having released the Judgment recovered by him against me on the 3rd of November 1881 in the Sullivan Circuit as required by the condition in that behalf contained in said Will and whereas I have on this twelfth of September 1882 paid to Richard Adams the Administrator of said Samuel Adams deceased the sum of $1918.95 in full payment of said Judgment.  Now there fore I revoke the residuary devise and bequeath made to said Samuel Adams in my said Will and I hereby give devise and bequeath all of his share and interest in m said real and personal Estate under said Will unto and equally between my sons William Adams and Richard Adams their heirs, Executors, Administrators and Assigns forever as provided for in said Will and in all other respects I confirm my said Will.
