Will of William Power
Written Feb. 6, 1844
Died at his residence in Scioto Co., Ohio Jan. 3, 1845
In the name of God, Amen I William Power of Green Township Scioto County State of Ohio do make and publish this my last will and Testament in manner and form following that is to say-I having it in contemplation to take a journey to the new Country west of this and knowing the uncertainty of this life and the certainty of death have thought best to settle my worldly concerns at this time And being in perfect health and of sound memory thank God for it. And, on mature deliberation have concluded to Care and devise unto my beloved wife Rebecca Power the farm I now live on, in lieu of her Dower situate and lying in Township County and State aforesaid at the mouth of Genat’s Creek containing one hundred and thirty six acres part of lot number thirteen in French Grant so called her natural life, and all the stock Household goods furniture and other goods and chattels which may be thereon at the time of my decease during her natural life time as aforesaid-and at the death of my said wife Rebecca, or before, if she sees proper the Real Estate aforesaid I give & bequeath to my son Washington Power and Elizabeth Power my 2nd daughter now living at home unmarried, in manner & form following To Washington I devise that part of said farm aforesaid, Beginning at a stone planted at the lower side of the gate in the Lane between Benjamin Woodard and my self (this stone in side of gate) Thence in a straight line to a stone planted near an old house, Thence to Grave to a stone planted near the Grave yard upper side of Grave Yard-from thence all the land I own in Lot No 13 to the back end of said lot number thirteen forever. Also one half of the dwelling house or rather the lower story one half of the well of water and half of Kitchen. Also to Elizabeth Power my second daughter I have and bequeath
All the remainder of my land in Lot number thirteen from said Washington’s first mentioned Line to my line on the Bank of the Ohio River one half of the well water upper story and garrett of my dwelling house half of Kitchen. Also to Elizabeth I give and demise the whole of the Lot of Land I purchased of Doctor William Belknap part of lot number twelve in French Grant so called except two acres of said Lot which I have sold to Darcus Payne and Benjamin Franklin Virbeck each one acre according to a written contract they now held for a Deed of conveyance when their notes of hand are paid and not before and if I should die before the notes are paid then I authorize Elizabeth Power, my second Daughter to make them a deed of Conveyance when their notes are paid containing in all eighteen acres after said deeds are made to the same more or less. Also to Washington and Elizabeth Power I leave and bequeath one hundred and thirty seven acres of Land lying and being (I believe) in Porter Township County and State aforesaid equally being land entered in Samuel Folsoms name and purchased by me at public outcry from John P. Turner Master Commissioner of County and state aforesaid. To Hannah Merrell my oldest Daughter I leave and bequeath and Asa Merrill her husband, their life times number of Entry 9878 at Shawnee town land office Illinois dated, September 9th 1842 containing eighty acres also number 9874 of same date and Land office aforesaid containing eighty acres also number 9880 in said Land office containing one hundred and twenty acres same date for description of said land reference to be had to certificates of entries or deeds if they should come in time and then to the heirs of Hannah Merrill for Ever. To Rebecca Lacroix my third Daughter and Alexander Lacroix her husband I will and bequeath five hundred dollars, two hundred of it paid down and the other three hundred dollars left of this five hundred when Jefferson Glidden pays up his notes which three hundred dollars is to be laid out for land where ever they may see proper to select it which land is to be theirs their life time and then fall to the heirs of Rebecca Lacroix for ever.
To Jane Trumbo my fourth Daughter and Andrew Trumbo her husband I leave and bequeath their life time number of entry in Shawneetown land office Illinois being 10,008 ten thousand and either dated second October 1843 containing one hundred & sixty nine acres 6/100 of an acre also tow hundred and eighty eight dollars sixty seven cents when Jefferson Glidden pays up his notes which tow hundred and eighty eight dollars and sixty seven cents is to be laid out for land where the said Jane and Andrew may see proper to select it and at their decease to go to the Heirs of said Jane Trumbo for ever the land above mentioned number 10.008 entry is the North west quarter of section number 5 five in Township No fifteen of Range No four East containing the above one hundred and sixty nine acres and 6/100 of an acre I do hereby revoke all former wills be made in testimony whereof I have heretofore set my hand and seal this sixth day of February 1844 Wm. my executors of this will is Hire D White and Wm Gilruth and I request them to act as such.
The following is a Codicil to aforesaid Will to wit “January 1st 1845. In my former Wills & Codicils there were some things I did not mention and having made some purchases of Lands since which time makes it necessary to make another as I am sick but of sound mind and memory thank God for it. First I leave and bequeath to my beloved wife Rebecca and Elizabeth my daughter the four eightys of my Barren Lands lying and being in Massack County state of Illinois on the upper side of Massack Creek three of Eightys joining and the other close by also I leave to Elizabeth my daughter the remnant of my store, and store books Notes of hand and accounts, all the judgments on Justices of Peace Dockets. Also I leave and bequeath to Washington Power my son a piece of Land known by the name of The farrow place in Massack County State of Illinois on the road leading from Metropolis City to Vienna. None of the Lands shall be sold during the life of the Children mentioned in this codicil. The ____ money I have is equally divided between Rebecca my wife and Elizabeth Power my daughter.
