William Rushing was a Baptist Minister in Union County, North Carolina. He preformed the marriage ceremony of his daughter, Sina and Needham Whitley.


WILL OF WILLIAM MALICHI RUSHING
In the name of God. Amen. I William M. Rushing of the County of Union and State of North Carolina, being sick and weak of body, but of sound disposing mind and memory, and considering the shortness of time and the certainty of death, and wishing to arrange my earthly affairs that God has seen fit to bless me with do make and ordain this my last will and testament in manner and form following (viz)

First and principally of all I commend my soul to God who gave it and my body to the earth to be buried in a decent and christian like manner at the disposal of my friends and relatives.

Art. 1st My will is that my Executors, here in after named, pay all my funeral expenses and just - debts out of money on hand or debts due and owing to me at my death, and if there is a defiency the balance to be raised from sale of property belonging to my estate.

Art. 2nd I give and bequeath to the children of my son Willis Rushing one hundred acres of land as marked on my plat adjoining the lands of the heirs of John Ashcraft and others.

Art. 3rd I give and bequeath to my son Andrew J. Rushing one hundred acres of land including his dwelling and adjoining lands bequeathed to the children of Willis Rushing - as marked on my plat - also fourteen acres more to be laid off so as to include his spring of water.

Art. 4th My will is that all of the balance of my estate not disposed of heretofore shall remain in the possession of my beloved wife Marab Rushing during her natural lifetime to use for the benefit of herself and daughters.

Art. 5th My will is that at the death of my beloved wife my executors sell and dispose of all that part od my estate which has not been used for the maintenance of my widow and daughters, both real and personal and divide the proceeds of such sale equally between my five daughters (viz) Mahala, Sina, Rebecca, Temperance and Assanneth or their legal representatives.

Art. 6th - And last. I appoint and constitute my trustworthy friends J. C. Griffin and Andrew J. Rushing my lawful Executors to all intent and purposes to execute this my last will and testament.

UNION COUNTY: IN THE PROBATE COURT

IN THE MATTER OF THE WILL OF

WILLIAM M. RUSHING

Before G.M. Flow, Probate Judge

JAMES C. GRIFFIN being sworn doth say: That WILLIAM M. RUSHING, late of said County, is dead, having first made and published his last Will and Testament; and that J.C. GRIFFIN is the Executor named therein.

Further, that the said WILLIAM M. RUSHING consisting of Real and Personal Property is worth about $1800., so far as can be ascertained at the date of his application; and that ABAGAIL RUSHING, MAHALA GARDNER, ATHENA GRIFFIN, REBECCA RUSHING, TEMPERANCE RUSHING, SINA WHITLEY'S HEIRS and A.J. RUSHING are the parties entitled under said will to the said property.

Sworn to and subscribed before me, this 14th day of Feby. 1873.

Return of the sale of the realty belonging to the Est. of WILLIAM M. RUSHING sold by JAMES C. GRIFFIN his Exe. by and under direction of the Last Will and Testament of the said W.M. Rushing died on the 30th day of October 1878.
After advertising according to the directing of the said Last Will and Testament and according to law.


Lot No. 1 - Was purchased by Mahala Gardner who was the last and highest Bidder. Said lot containing 90 acres at the sum of $3.00 per acre - $270.

Lot No. 2 - Was purchased by Rebecca Rushing who was the last and highest Bidder. Said lot containing 90 acres at the sum of three dols. per acre - $270.

Lot No. 3 - Containing 91 Acres was purchased by W.R. Nance at the sum of $2.75 per acre -
$250.25

Lot No. 4 - Containing 90 acres was purchased by Athena Griffin who was the last and highest bidder at the sum of $3.00 per acre - 270.00

Lot No. 5 - Containing 87 acres was purchased by Temperance Tice who was the last and hoghest Bidder at the sum of $3.40 per acre - $295.80

Total - $1356.05

The understanding under which said land was sold, was that title would be made upon payment of the purchase money.
The terms being Twelve months credit as to two-thirds of the purchase money and as to the ballance of the purchase money a Credit of six months.
