The Following are the records of a Court Case filed by Ada and Robert
Thompson in 1897 concerning the management of their estate by McAllister
Vinson:

Fifth District Court
Parish Of Ouachita
State Of Louisiana

Tutorship of the heirs of Eliza and J.T. Thompson

Now come Miss Ada Thompson and Robt E. Thompson, both residents of said parish and state and respectfully represent to the Court that they are children of Mrs. Eliza Thompson and John T. Thompson who died in your said parish, the former in August - the latter in September, 1880 - when petitioners were minors. Aver that M.A. Vinson of said parish qualified as administrator of the succession of said deceased and administered same in you Hon Court and, upon filing his final account of said Succession, there was considerable property, real and personal coming to the heirs, of whom there were five, to wit: a half brother named William T. Grant, who was the child of Mrs. Eliza Thompson by her former marriage and Joseph, Melvin, Ada and Robt. E. Thompson. Petitioners represent that M.A. Vinson in June, 1881 was appointed and qualified as tutor of all of said children and as such received and rented the real estate belonging to them and lent out the money and collected interest thereon. They aver that their said Tutor has settled with the other heirs but has refused to settle with petitioners, both of whom are now of age. They aver that their said Tutor owes them a considerable amount and they desire and are entitled to an account and settlement of said tutorship.
Wherefore they pray that M.A. Vinson, tutor, be ordered to file in the Clerk's Office of the Fifth district court in and for the Parish of Ouachita, on a date to be fixed by your Honor, a full, fair and final account of the tutorship of Ada Thompson and Robt. E. Thompson, children, and heirs of Eliza and J.T. Thompson deceased. Further pray for all necessary orders and decrees and for general relief.

Tutorship of the Heirs Fifth District Court
Of Eliza and J.T. Thompson Parish of Ouachita
#45 60 Deceased State Of Louisiana

Now comes Miss Ada Thompson and
Robt. E. Thompson, residents of said parish and state and respectfully represent to the Court that
They oppose the account of their tutorship filed by M.A. Vinson, tutor, November 10, 1897 on
The following rounds, to wit : They aver that the item of the account fixing the virile portion of each opponent herein at $199.02 should be increased so as to give opponents interest on that
Sum from the 21st day of December 1885 at the rate of eight per cent per annum until paid. They
Aver that after filing his final account, as administrator of the Succession of Eliza and J.T. Thompson,
the tutor had left in his hands a valuable piece of real estate situated in the Colony which produced an annual revenue and was always easily rented. Aver that in December 1885 , without any necessity and without proper legal formalities, their tutor sold said farm at private sale for five hundred and seventeen dollars cash. They aver that under the law, it was his duty as tutor to invest this sum and they aver that he did lend out said money or a part thereof, at Remunerative rates of interest.
They aver that the sale of said farm deprived them of its revenue and whether said tutor
let out the funds or not, he is bound to pay interest thereon, under Article347 of the Civil Code.
Opponents deny each and every item of credit claimed by the tutor. They aver that at no time did the said tutor apply for or obtain the authority and advice of a family meeting as required by Article 350 of the Civil Code to authorize him to expend any part of the capital belonging to the minors represented by him for their education or subsistence. Aver that he had no authority or right to expend anything on the education and support of opponents in excess of the revenues of their property. They deny that the tutor did expend anything on their education and support; but aver that they lived with him on his farm and assisted in the labors of the household and farm And that their services were worth far more to
the tutor than the small amount necessary to clothe and feed them.

Opponent, Robt. E. Thompson declares that the tutor never spent any thing on his education
and that he worked in the field from early childhood until he left said tutor at about the age of Fourteen.

Opponent, Miss Ada Thompson, represents that in the Spring of 1897, without having rendered any account as required by Article 361 of the Civil Code, her tutor executed a note in her favor for one hundred dollars on the account of the amount due her on her tutorship. Avers that this settlement was not preceded by any account of said tutorship and was null and void. Further avers that the tutor retained possession of said note and she has never collected anything Theron.
Wherefore, the premises being duly considered, opponents pray that the account be amended
as herein set forth - that the items claimed by the tutor for the expenses and support of opponents
be rejected and that on final trial that opponents each have and recover judgment
Against their said tutor, M.A. Vinson for the sum of one hundred and ninety nine and 02/100
Dollars with eight per cent per annum interest from the 31st Day of December, 1885 until paid.
They further pray that their minors mortgage be recognized and rendered executory for said amount against the real property of their said tutor M.A. Vinson and for general relief.

Tutorship of the Minor
Heirs of Elizabeth & J.T. Thompson

Mrs. Ada Gibbs (nee Thompson)
I am one of the 3 opponents in this case. Maiden name was Ada Thompson. My father and mother was John and Eliza Thompson. I married Nov 7 1897. I was about 6 years old when my father and mother died. I am now 22 years old. After my father and mother died I don't know how long I lived with my uncle. I did not live with my uncle regularly all the time. While I lived with my uncle Mack I cooked, washed and did all kinds of housework. He was not a widower at that time. Afterwards he became a widower and I did the same. When I was about 10 years old my uncle gave me to a Mrs. Smith in Mississippi. I lived there for about a year when my brother Joe came after me_______after this I went to the Hills and stayed about 3 years. When I left Monroe the first time I went to Mrs. May Puckett s and stayed with her and Mr. Vinson came after me and made me go to his house. I don't know how long I stayed with Mr. Vinson that time. I went to school at that time. I went to school in Bastrop sometime and boarded with Mrs. Grant. It has been about 9 since I lived with Mr. Vinson. I have been to no expense to him during that time.
I went down to Mr. Vinson's house in Feb1897 to get a settlement owed. He told me he did not owe me anything at all. When he offered me $25.00 and I told him I was not satisfied of that item he offered me $70.00 and he made me out an account but he never did settle. He wrote a note $100.00 and kept it himself. I have never seen the note since. To the best of knowledge in 1889 I was in Jackson Parish with my uncle and Mr. Vinson did not pay my board. I boarded with Mrs. Furnace and went to school. I don't know how long I stayed there. Mr. Vinson says he paid my board. I boarded with Mrs. N.A. Grant at $5.00 per month but don't know how long I stayed. I was very small.
Cross examined at ______ ______________.
I boarded and went to school in Oak Ridge don't know how long I stayed. I know I was there. I suppose my uncle Mack paid my board and tuition. Mr M.A. Vinson paid my board while I stayed with Mrs. Grant at $5.00 per month. I went to school to Mrs. Grant in her house during the time I stayed with Mrs. Furnace. I went to school in Bastrop. Mr. M.A. Vinson paid my board during the time I was with Mrs. E. Furnace.
Redirect
During the time I was in Oak Ridge I went to school about 2 months.
Robert E. Thompson sworn says,
I am one of the opponents in this case. My name is Robert Ernest Thompson. I was 21 years old last December. My uncle never told me my exact age. I was about 5 years old when my father and mother died. It has been 7 years last November since I left my uncle M.A. Vinson. I have been no expense to him since I left. I don't think I was any expense to him before I left him from the way he worked me plowing, hoeing and doing other work. I went to school in Bastrop about one month or one and half months and boarded at Mrs. Furnaces. I never went to any other school except public schools at home. I was 14 years old when I left there. I stayed one with my brother Joe and afterwards went to work for Mr. H. Rob___ for $8.00 and board first year and next year $10.00 and board.
      Cross examine
During the time I went to school to Mrs. Furnace M.A. Vinson furnish the provisions. There was no board and paid my tuition.
Joe Thompson sworn says opponent. My name is Joseph Thompson. I am 29 years old. My father and mother were John & Eliza Thompson. Their children were Joseph, J.M., Ada, R.E. Thompson. My mother had a son by a former marriage by name W.T. Grant. M.A. Vinson as Tutor has settled with me, W.T. Grant and J.M. Thompson. I never lived with M.A. Vinson only visited him. M.A. Vinson was a farmer after my fathers death. He has a small farm in woods 2 near Lock Arbor. Robt Thompson never lived with M.A. Vinson for two years after the death of my father and mother. He lived with my Uncle Warren for about 2 years and then M.A. Vinson took him to his house. He was there about 7 years old. He worked on the farm with the exception of what little time he went to school. While he was on the farm he plowed, hoed, picked cotton and other things that came up. I consider him as good a hand as there is in the neighborhood. I am a farmer. He was $8.00 per month to me and his board and my wife did his washing and made his clothes. At the time when Robt was a boy he was worth $8.00 per month and board. At the time he first went to my uncles he work was worth more than his board. His work was worth his board and clothing and in my judgment more he could have gotten _____ or any other place. When he was about 10 years old I heard my uncle M.A. Vinson say he was worth as much as any hand he had and at the time he had some he was paying $12.00 per month and board.
I am boarding my little girl at $3.00 per month now. About the years 80 & 81 some boys were paying $5.00 per month for board, washing & ironing. At that time I think a child could have been boarded in the country for $5 or $6.00 per month. Ada went to M.A. Vinson's after my fathers and mothers death. She stayed with him about a year when he gave her to Mrs. Leuion and she stayed there about a year. From the time Ada went to live with M.A. Vinson she worked in the kitchen and field. While she was there I think her work was worth her board. While he was a widower she stayed at the house and after he married she stayed in the field and worked all the time. The 40 acres land sold in the Colony was the Homestead of my father and mother. The money that M.A. Vinson received for the place he applied to his own use in farming the next year and lent part of if out at interest of 20% and 25%. I borrowed some myself.
      Cross Examined
During the two years Robt lived with his uncle Warren, no one paid his board. I am not on good terms with M.A. Vinson and have not been for seven or eight years.
M.A. Vinson sworn for account ___, says:
I am the Tutor and account ___ in this case, am also Adm of Succee J.T. and Eliza Thompson dec'd.
Examined your final account filed herein and state whether or not the items of debit and credit there on are correct. This account is correct with the exception of the balance due Ada and Robert E. Thompson as I will portion $199.01 each amounting to $398.02. The correct amount should be $168.90 due to each.
After the death of their father and mother I had charge of the minors Ada and Robert E. Thompson until they left me. At the time of the death of their father and mother, Robert E. Thompson was born as near as I can recollect in month of April 1877. I am lead to this conclusion from what my neighbors told me. Ada Thompson I could not say when she was born she is older than Robert. After the death of their parents Robert Thompson was about 3 years and 4 months old when I took him to my house. Ada was between 5 and 6 years of age to the best of my knowledge. At that time neither of the children were large enough to be of any service to me or my wife. Robert did not stay with his uncle Warren after his parents death. In the year 1889 Robert was between 12 and 13 years old when he went t work the first plowing he ever did. Before that he never did any regular work. He might have hoed some. There was never any family meeting held to advise the use of these minors property. I go the $517.00 from Julius Lemle for the 40 acres land in Dec 1885.

What did you do with that money?
I retained it in my possession.
How long did you keep this money in your possession and where did you keep it?
All the cash I ever had I kept at home in my trunk. I kept it there from time to time and retained such a portion as they were due me for my account against them. I put the $517.00 in my trunk but did not keep it there in certain length of time. I did not loan any of that $517.00. The place was ______ _______
the year 1882 and I did not collect any rent for that year.
Accountants offers voucher from No.1 to No.12 inclusive.
Mrs. Hattie A. Cox sworn for accountant. I am acquainted with Miss Ada Thompson but don't know how long I have known her. After the marriage of Mr. Vinson and my mother I lived with them about a year but can't say how long I lived with them after that. During the time I lived with Mr. Vinson and mother Ada did no work in the field except pick cotton with me late in the evening and for this Mr. Vinson purchased us fancy dresses, bonnets and trimming to match. My mother, Ada and myself did the housework and a colored woman did the washing.
At the time Miss Ada refers to in her testimony when I was a widower she was in my house from the 24th day of Feby to the 3rd May same year. During that time she had measles and I had a white lady by the name of Mrs. Dean on the place if my memory serves me right she assisted in the work. During a portion of that time I was gone to New Orleans. At no time did she do all of my cooking and household work or washing, but she did assist in it but not during the years for which I have made charges against her. During the time the minors were with me I boarded and clothed them.
What became of the vouchers referred to in your final account?
I left them in the hands of Mr. T. Vaughn the Atty who filed the final account.
Miss Ada Thompson never worked for me in the field at any time except picked some cotton which I paid her for she did that voluntarily.
I never asked Ada to do any work in the field at any time.
Robert Thompson left my house in the year 1890 I think in Sept.
I think in 1889 he commenced plowing in May. I think he plowed until the crop was laid by. Prior to that time he did no regular work except he did errands and in the fall pick some cotton. He also worked for me on the farm in 1890. During the years 1880, 1, 2, 3 & 4 he did no work for me whatever.
I never loaned any funds belonging to the heirs of that Est. to anyone at any rate of interest.
      Cross Examined
When Eliza and John Thompson died I was living in the neighborhood of Sackharbor. I was a man of family. O took the children to my house to live with me and my family. At that time I had a small farm.

I have been acquainted with M.A. Vinson since 1859 and have lived near him during the time. I am acquainted with R.E. Thompson, have known him all his life. I visited Mr. Vinson frequently during the time Robert lived with him. To the best of my recollection I saw Robert plowing in the field for Mr. Vinson. Robert went to school during the time he lived with Mr. Vinson. Robert could not have done much fieldwork prior to 1889.
