SMITH August 14, 1876 in Morehouse Parish. She was born 1853 in Mississippi, and died Unknown in Ouachita Parish, Louisiana. He married (3) DORA WINSTEAD March 12, 1894 in Ouachita Parish, Louisiana. He married (4) IONA WILKES April 10, 1898 in Ouachita Parish, Louisiana.

Land Purchase in year 1895, in Book 36, on Page 547.

Now comes Mrs. Iona Vinson, surviving Widow in community of M. A. Vinson, deceased and avers that W. J. Vinson has applied to the appointed administration of the succession of M. A. Vinson. Petitioner arrears that as surviving widow and partner in community, she has a right of preference to administer the community property. Arrears that all the property made and created since the Tenth day of April 1898, the date when petitioner married said M. A. Vinson, belongs to the community . Avers that said
M. A. Vinson owned a farm prior to her marriage to him, which belongs to the community between him and a former deceased wife, but that the rents and revenues of said plantation and the improvements and (unreadable words) made thereon during the existence of the community belongs to the community between petitioner and her deceased husband. Avers that eighteen bales of cotton, three hundred bushels of corn, ten tons of cotton seed, the increase of hogs and cattle since her marriage, also that one buggy acquired since her marriage to petitioner belongs to the community between them; also certain household goods including a rocking chair, acquired since belongs to the community. Petitioner represents and avers that she is entitled to administer and control said community property and entitled to the use there of during widowhood. Arrears that said M. A. Vinson left no debts whatever and that there is no necessity for an administrator. Therefore petitioner prays that the application of W. J. Vinson be rejected in so far as relates to the community property acquired by M. A. Vinson subsequent to the tenth of April 1898 and belonging to the community existing between petitioner and said M. A. Vinson. Prays that said community property may be ministered and appraised separately, and that petitioners right as surviving widow in community to hold, possess and administer said property as us ufrnchiary, be recognized adjudged and deemed but the spirit; and all of said community property be ordered turned over to petitioner as usnfiuctuary and that the community have fridy ruent against the separate estate of M. A. Vinson for the amount that said separate property has been increased in value by said community to wit the sum of Three hundred and fifty dollars. She further prays for all necessary orders and decrees and for general relief.

Be it known, that on this the fifth day of December A.D. 1899, in pursuance of an order from the Honorable Fifth District court in and for the said parish, dated November 17, 1899 and directed to me, R. A. Young, Clerk of the Fifth District Court and Ex-Officio notary Public in and for the said Parish, requiring me to make an Inventory and Appraisement of all the property, real and personal, rights and credits belonging to the Succession of Mack A. Vinson, Deceased, lying and being in said Parish, I have in compliance with said order, appointed J. R. Herron and A. J. McQuiller, Jr., appraisers to appraise said property, who took and subscribed the following oath: " We and each of us do solemnly swear that we will to the best of our ability and understanding, appraise all the property belonging to and composing the succession of Mack A. Vinson, deceased, situate and being in the Parish of Ouachita, State of Louisiana, which may be show to us or come to our knowledge. To the honorable Judge of the fifth district court in and for the Parish of Ouachita, State of Louisiana:
The petition of Mrs. Iona Vinson respectfully represents that she is the surviving spouse of M. A. Vinson, deceased, who died in your said Parish on the 13th of November, 1899; and that there is one child, offspring of the marriage between petitioner and said M. A. Vinson, namely, John McIntosh Vinson, aged about nine months, and that said minor child is one of the heirs of said M. A. Vinson, who left an estate of real and personal property in your said Parish. Petitioner avers that she desires to be confirmed as Natural tutrix of said minor, John McIntosh Vinson, in order to have said child's portion of said estate turned over to petitioner to be administered too by her according to law. Wherefore, petitioner prays that an inventory of the estate of said minor be made, that a certificate of said inventory be duly recorded, and that she be duly qualified and confirmed as Natural Tutrix of said minor John McIntosh Vinson upon taking the oath required by law; and for general relief.

John McIntosh Vinson on Dec 22, 1899 and he was awarded a 10th of the Estate of
M. A. Vinson.
Then on Jan 15 1902 the Judge of the 6th District of Ouachita Parish , L. E. Hall,
approved the sale of his portion of the Plantation for $400.00

To the Hon. the Judge of the Fifth District Court, within and for the Parish of Ouachita and State of Louisiana: -
The Petition of William J. Vinson, a resident of your said Parish and State, respectfully shows:
That he is the son and only child of the late M. A. Vinson by his first marriage.
That his Father, M. A. Vinson, died on the 13th day of November, 1899, in your said Parish and State, where he had lived all of his life.That he was possessed of a considerable estate of both real and personal property, at the time of his death, situated in the Parish of Ouachita.
That he owed little or no debts; that he left three children issue of his second marriage with Amanda Adams, all minors; that he left a widow Iona Wilkes, and one child, issue of his marriage with her; that some of his property was acquired during his first marriage, and some during his second marriage, but very little during his last marriage. That his Estate consists now principally of a Plantation in your said Parish and State, known as "The Wallace Place", which he has been cultivating for some years, and was cultivating this year; that the affairs of the Plantation for the current year are yet unsettled; the crop only partly gathered and unsold, and that an inventory of his Estate, is, in the opinion of your Petitioner, absolutely necessary to keep a record of its assets, and for the determination and settlement of the various interests of himself and his co-heirs thereunder. He, therefore, prays for an order for an Inventory of the Estate of the late M. A. Vinson, deceased, and for the appointment of an Administrator of said estate, after due notice has; and as he is the nearest male relative of age, that Letters of Administration issue to him, upon complying with the law.
The foregoing Petition considered, it is ordered that the application of William J. Vinson, to be appointed administrator of the Estate of M. A. Vinson deceased, be advertised according to law; That an Inventory and Appraisement be made by R. A. Young, Clerk.

Amanda W. Adams, deceased. § State of Louisiana.
The Petition of William J. Vinson, of your said Parish and State, respectfully shows:
That his Father, M. A. Vinson, died recently in your said Parish, possessed of considerable real and personal property. That your Petitioner is a son of the first marriage. That by his second marriage with Amanda Adams, there are still living, three children, to-wit: Rose E., aged twelve years, Grover W., aged nine years, Allie E. aged eight years. That both the Mother and the Father of said children are dead. That your Petitioner is a half Brother by a former marriage, of the minors, and is the only near male relative of said children. That your Petitioner, with said minors, inherited from their Father and Mother, each about one fourth of their estate; which amounts to approximately One Thousand Dollars each, and for the three minors, Three Thousand Dollars. That in addition thereto, your Petitioner and the minor children are the beneficiaries of a life policy for Two Thousand ($2,000.00) Dollars, on the life of their said Father, in the Mutual Reserve Fund Life Association, in equal proportions, or ($750.00) Seven Hundred and Fifty Dollars each. That the Estate then of each of said three minors will amount to Seventeen Hundred and Fifty ($1750.00) Dollars, or about Five Thousand Two Hundred and Fifty Dollars. That there is no one to administer their said estate; that they are without a Tutor, and it is absolutely necessary that a Tutor shall be appointed and qualified, to collect the life policy aforesaid, or there is danger of its being lost.
Your Petitioner represents that there is no relative of the children who is able to give the security necessary under the law for the administration of the minors Estate. But your Petitioner, by reason of his affection for his brothers and sisters, his co-heirs, and the care of their estate falling naturally upon Petitioner, he is willing to assume all the responsibilities imposed on him by law as their Tutor, but is unwilling and unable to obtain the security for his bond as Tutor, and after canvassing the neighborhood, he finds that it is absolutely impossible to get any one to take the Tutorship of the said minors and give the security required. He therefor prays that Your Honor will order a family meeting to be composed of the relatives, and friends in default of relatives, of the said minors, to be convoked before R. A. Young, Clerk of the Fifth District Court, and Ex-Officio Recorder and Notary, for the purposes of:
1st. Naming a Tutor for said Minors, and also an Under-Tutor. and 2nd. For determining whether, in case they are satisfied that no one will accept appointment and give the bond, the Tutor recommended by them, shall be absolved from the requirement of giving the security as required generally under the law.
Petitioner further prays for all orders and decrees necessary in the premises, for costs and general relief.

The foregoing Petition considered, it is ordered that a meeting of the relatives of the minors, to-wit: Rose E., Grover W., and Allie E. Vinson, children of the late Mack A. Vinson, be convoked before R. A. Young, Clerk of the Fifth District Court and Ex-Officio Recorder, on this 5th day of December, 1899, for the purpose of consulting as to the interest of the said minors and the care of their estate; and for recommending a suitable person to be appointed as Tutor for said Minors, and another discreet person as Under-Tutor for the same; and if they find that no one will undertake the Tutorship and give the security, that they advise whether the Tutor may enter upon the discharge of his duties without such security.
It is further ordered that William T. Grant, a Cousin-Germain, and in default of other relatives, George W. McQuiller, Joe R. Herron, A. J. McQuiller, Jr. and Mark H. Durham friends and neighbors, of the Minors, be appointed to compose said Family Meeting. And that an Inventory of the Estate of said minors be made.

After which I proceeded to read the Petition of W. J. Vinson, and they discussed the matter among themselves, all expressing a thorough acquaintance with the condition of the property and of the children. We recommend, that since it is known to us that none who is qualified to act as Tutor for them can give the bond, we recommend that their only Brother of age, William J, Vinson, be appointed Tutor of the said Minors, and that W. T. Grant, their Cousin-Germain, be appointed as Under-Tutor. We further recommend that since it is impossible for the Tutor to give the bond required, that on the due record of the Inventory, showing the Estate of the Minors, in the Mortgage Records of Ouachita Parish, that the Tutor recommended by us, be relieved from the duty of giving security for his administration, and that letters of Tutorship issue, upon the record of the inventory aforesaid. IN TESTIMONY WHEREOF, the members of the said family meeting hereunto sign their names, in the presence of the undersigned lawful witnesses, and me said Clerk and Notary, on this the 5th day of December, A. Vinson, deceased, I proceeded with the discharge of said duty by summoning Albert McQuiller and Joe Herron as appraisers, who took and subscribed the following oath:

Whereupon the interest of the three minors in the Estate of their late Father and Mother, was by them fixed and valued, net at Three Thousand Dollars, or One Thousand Dollars for each of the minors. Their interest in the life policy in the Mutual Reserve Fund Life Association, on the life of their Father, we value at Seven Hundred and Fifty ($750.00) Dollars each, being one fourth interest, aggregating the amount of Two Thousand, Two Hundred and Fifty ($2250.00) Dollars, making the Estate of the Minors altogether Five Thousand Two Hundred and Fifty ($5250.00) Dollars, or the share of each therein, Seventeen Hundred and Fifty ($1750.00) Dollars, and there being no other property, the said appraisers signed this Inventory and Appraisement, in the presence of Frank P. Stubbs and Rob J. Willson witnesses of lawful age and domicile, and me, Notary, on this the 5th day of December, 1899.

Your Petitioner shows that at his said appointment, the said Vinson collected Twenty-two Hundred and Fifty ($2250.00) Dollars in money belonging to said minors and sold considerable property belonging to them, for cash, the price of which was collected by said Vinson. Petitioner shows further, that at the time of the appointment of said Vinson, as Tutor, your Petitioner was appointed and qualified as Under-Tutor of said minors. Petitioner shows that he is informed that since his said appointment, the said Vinson has been extravagant and profligate in his habits, and that Petitioner is fearful that the interest of the minors will suffer unless they are protected by the Court. Petitioner shows further that in accordance with the provisions of Article 275 of the Civil Code, he now, and hereby gives notice to this Honorable Court that more than a year has transpired since the appointment of said Vinson, and that he has failed to render his annual account as Tutor, as required by law. Wherefore, Petitioner prays for an order from this Honorable Court, directing the said William J. Vinson to file an annual account of his administration, as required by law; and for all such further orders and decrees necessary in the premises, for all costs and general relief.

Now comes Mrs. Iona Vinson, surviving Widow in community of M.A. Vinson, deceased and avers that W. J. Vinson has applied to the appointed administration of the succession of M. A. Vinson. Petitioner arrears that as surviving widow and partner in community, she has a right of preference to administer the community property. Arrears that all the property made and created since the Tenth day of April 1898, the date when petitioner married said M.A. Vinson, belongs to the community . Avers that said M.A. Vinson owned a farm prior to her marriage to him, which belongs to the community between him and a former deceased wife, but that the rents and revenues of said plantation and the improvements and ( unreadable words) made thereon during the existence of the community belongs to the community between petitioner and her deceased husband. Avers that eighteen bales of cotton, three hundred bushels of corn, ten tons of cotton seed, the increase of hogs and cattle since her marriage, also that one buggy acquired since her marriage to petitioner belongs to the community between them; also certain household goods including a rocking chair, acquired since belongs to the community. Petitioner represents and avers that she is entitled to administer and control said community property and entitled to the use there of during widowhood. Arrears that said M.A. Vinson left no debts whatever and that there is no necessity for an administrator. Therefore petitioner prays that the application of W.J. Vinson be rejected in so far as relates to the community property acquired by M.A. Vinson subsequent to the tenth of April 1898 and belonging to the community existing between petitioner and said M.A. Vinson. Prays that said community property may be ministered and appraised separately, and that petitioners right as surviving widow in community to hold, possess and administer said property as us ufrnchiary, be recognized adjudged and deemed but the spirt; and all of said community property be ordered turned over to petitioner as usnfiuctuary and that the community have fridy ruent against the separate estate of M.A. Vinson for the amount that said separate property has been increased in value by said community to wit the sum of Three hundred and fifty dollars. She further prays for all necessary orders and decrees and for general relief

To the honorable Judge of the fifth district court in and for the Parish of Ouachita, State of Louisiana:
The petition of Mrs. . Iona Vinson respectfully represents that she is the surviving spouse of M.A. Vinson, deceased, who died in your said Parish on the 13th of November, 1899; and that there is one child, offspring of the marriage between petitioner and said M.A. Vinson, namely, John McIntosh Vinson, aged about nine months, and that said minor child is one of the heirs of said M.A. Vinson, who left an estate of real and personal property in your said Parish. Petitioner avers that she desires to be confirmed as Natural tutrix of said minor, John McIntosh Vinson, in order to have said child's portion of said estate turned over to petitioner to be administered too by her according to law.
Wherefore, petitioner prays that an inventory of the estate of said minor be made, that a certificate of said inventory be duly recorded, and that she be duly qualified and confirmed as Natural Tutrix of said minor John McIntosh Vinson upon taking the oath required by law; and for general relief.
