In the name of God amen, I, Thomas Lamoreaux of Plymouth in the county of Luzerne and commonwealth of Pennsylvaniabeing in a common state of health in body and in perfect memory thanks be to God for the same and calling to mind the state of mortality that I must yield to death when it where it shall please God to call me do make and ordain this my last will and testament in manner and form following viz:

First I give and committ my soul into the hands of God that gave it and my body to the dust from whence it came, to buryed in such place and in such manner as my exevutors hereafter named whall order and direct in hope of a glorius immortality beyond the grave, and in full assurance of the resurection of this my mortal body, and now as to the settling of my estate which it hath pleased God to put into my hands

I do will order and direct in manner and form following viz: first that all my debts and funeral charges be fully paid and satisfied by my legacies in equal proportions to what they receive

First To my beloved wife Keturah I give and bequeath the use of one third part of all my real and personal property as the laws of (?) land hath made & provided Likewise the best horse saddle & bridle that I am possessed of and one hundred dollars.

To my son James Lamoreaus's son, Jewel Lamoreaux a cripple child I make equal with my daughters as I am not disposed to give my son James anything on account of his disobedience to me (my son John to witness the same) that is Martha Pringle, Elizabeth Ransom Temperance VanLoon, Charity Steel, Hannah VanLoon, Keturah Ackley, Milly Lamoreaux, Jane Lamoreaux my daughters
John Lamoreaux, Thomas Lamoreaux, Joshua Lamoreaux, Daniel Lamoreaux my sons, I do hereby authorize my executors or whom they may appoint to appraise my real & personal and then to be proportioned as follows viz;
to my sons Thomas, Joshua & Daniel each double to any of my daughters and my daughters above named equal each with my grandchild Jewel, with the following exception and directions to be observed and attended to viz:
To my son John Lamoreaux one hundred dollars as he has had before of my property. to my Grandson James VanLoon, if he lives and continues with me my wife or son Daniel till he arrives to the full age of twenty one, then to receive from my Executors two hundred and sixty six dollars of my estate also that part that shall set off to Temperance VanLoon be for her own personal use and her children to be in the hands of my executors at their discretion with my daughter Temperance and also Charity Steel's portion in same way and manner with her sister Temperance

Also I do hereby ordain constitute and appoint my son John Lamoreaux with Griffin lewis and Jonah Rogers my sole executors to execute this my last will and testament with two years time to settle the same in. In testimony whereof I have hereunto set my hand and seal this fifteenth day of April one thousand eight hundred & fifteen.

Codicil to this my last will and testament still remaining in full stong mind do make this alteration viz:
that as I willed to my son Thomas Lamoreaux, Junr considering his interferance and bad conduct do hereby revoke the former and do now give and bequeath to his son Wesly Lamoreaux that part willed before to my son Thomas aforesaid to be and remain in the hands of my executors untill my grandson Wesley Lamoreaux arrives at full age of twenty one, then to be paid by my Executors to him aforesaid Wesley, Also to my son John Lamoreaux fifty dollars only considering more intensely the priviledges already he has had and received from me. As witness my hand and seal this ninth day of November one thousand eight hundred twenty six.

THOMAS DAVENPORT

Be it remembered that Thomas Davenport of the township of Plymouth in the county of Luzerne being weak in body but of sound mind and memory blessed by God for the same, do make and publish this my last will and testament in the manner and form following, that is to say: First, I order my debts and funeral expenses to be paid. I give and devise to my six sons viz: John, Thomas, Robert, Samuel, Daniel and Stephen all my lands situated in the township of Plymouth aforesaid the houses buildings improvements and improvements and appurtenances thereunto belonging or in anywise appertaining, together with all my other freehold estate to hold to them their heirs assigns forever subject however to the payments and encumbrances hereinafter mentioned to be equally divided between the said John, Thomas, Robert, Samuel, Daniel and Stephen as they may agree to divide the same among themselves but if it should so happen that they cannot agree upon the division, then and in such case they shall each choose one man who shall make the division of said lands agreeably to the intention before mentioned, and it is my will that my several sons shall work the lands & premises aforesaid together for the term of nine years from my decease and support their mother and as heretofore with all things necessary and convenient for such a family, and the surplus profits if said lands shall be equally divided, among my three sons John, Thomas & Robert until my sons Samuel, Daniel and Stephen shall severally arrive at the age of eighteen years, then they shall severally share equally by their other brothers there after in the profits of said lands as they severally arrive at the age of eighteen years aforesaid. Equally when my said son, Samuel is at eighteen years of age he be furnished out of the profits of my said lands with a ? Good horse of about the age of five years and good saddle obn? And my said sons Daniel and Stephen shall be each furnished likewise with such horse saddle and bridle when they shall arrive at eighteen years of age. I also give to my son Stephen at the death of his mother a good feather bed and bedding.

And my will is that my three eldest sons viz: John, Thomas and Robert do pay to my executors hereinafter named severally the sum of one hundred and ninety two dollars at the expiration of four years from my decease and my two sons Samuel and Daniel severally to pay to my executors aforesaid the sum of one hundred and ninety two dollars at the expiration of said time from my decease.


I give to my beloved wife, Charity Davenport one third of my land with the dwelling house in which I now reside and the garden thereunto belonging and the privilege of one half the orchard for apples on my said lands during her life. I also give to my said wife, Charity, all my household goods and furniture of what kind or nature soever during her life. I also give to my wife Charity under care and do ? all my stock of cattle, sheep & service, but it is to be considered that my said sons is to have the free use of my said stock of all denominations and my farming utensils and implements of husbandry during the term of nine years as aforementioned in which they work the lands and premises together as has been done heretofore, but it is my will that the cattle & sheep not be disposed of without the consent and agreement of said wife during the said term.


And it is my will that the value of the said stock and implements of husbandry shall not be depreciated or impaired unless accident during the term aforesaid and at the expiration of nine years as aforesaid I give to my said wife, Charity her choice of cows out of said stock that shall then be and the remainder that there are left and my farming utensils I give to my sons viz: John, Thomas, Robert, Samuel, Daniel and Stephen to be equally divided between them.


And it is further my will that my two youngest daughters Franky, Phebe be made equal to their two other sisters by cows out of the stock of the lands aforesaid and by furniture to be provided for them by their Mother out of my estate or profits thereof. And it is my will that after the death of my said wife aforesaid it is my will that the household furniture left by her be equally divided among my four daughters Elizabeth the wife of Abraham VanLoon, Hannah the wife of Jacob Gould, Frankey the wife of William Craig and Phebe.


And I further will and direct my executors hereinafter named to my daughter Elizabeth VanLoon four years from the time of my decease the interest accruing on two hundred and forty dollars ?ly from the said four years during her life, but if at any time my said daughter Elizabeth should become a widow then and in such case it is my will that my executors do pay to my said daughter, Elizabeth the said sum of two hundred and forty dollars and her interest should cease, but if it should so happen that my said daughter Elizabeth should become infirm and have no maintenance, then it is my will that my sons shall jointly provide her with a home and reasonable maintenance, but it at anytime during her coverture my Executors shall be of opinion it is necessary for the support of my said daughter Elizabeth that she shall have a further support that her interest named in my will is that my executors do pay to my said daughter from time to time so much of the two hundred and forty dollars as to ? May appear right, and at the death of my said daughter Elizabeth the two hundred and forty two dollars above mentioned or the remaining part thereof, if any shall be divided as follows, one half thereof, ? Half thereof I give to my grand daughter Charity daughter of said daughter Elizabeth and the other half to be equally divided among the other children of my said daughter Elizabeth.


It is also my will that my Executors do pay to my daughter Hannah Gould to hundred and forty dollars at he expiration of four years of my decease, and to my daughter Frankey the sum of ninety six dollars at the expiration of four years after the time of my decease and the further sum of one hundred and forty four dollars at the expiration of six years from the time of my decease, and to my daughter Phebe Davenport the sum of two hundred and forty dollars at the expiration of six years from the time of my decease, or if she shall be of the age of eighteen at that time then to be paid to her on her arrival at eighteen years of age.


It is also my will that my sons will find a good horse for their mother to ride whenever she may desire one.


And Lastly I hereby appoint my sons John Davenport, Thomas Davenport and Robert Davenport and my friend Jesse Fell Esq. of WilkesBarre my sole executors of this my last will and testament hereby revoking all former wills by me made, In witness whereof, I have hereunto set my hand and seal this twelfth day of August in he year of our Lord one thousand eight hundred and nine.

Be it remembered that on the twentieth of May Anno Domini one thousand eight hundred and twelve before me George Denison, Register for the probate of Wills and granting Letters of Admnistration in and for the county of Luzerne personally came Thomas Lameraux and George P. Ransom and being duly sworn do respectively say that thier names to this instrument subscribed are of their own proper handwriting, that they saw Thomas Davenport the testator therein named sign and seal heard him publish and declare the foregoing Instrument writing as and for his last will and testament, that at the time of doing thereof the said testator was of sound mind & memory and of a disposing understanding to the best of their knowledge and belief, that they signed their names thereto as witnesses at the request and in the presence of the testator and in the presence of each other, and that they saw James Roberts, Jr. also sign the same as a witness in the presence of the testator.

The Will of
SAMUEL DAVENPORT

In the name of God, Amen, I Samuel Davenport of Plymouth Township in Luzerne county and the commonwealth of Pennsylvania, being weak in bodily health by of perfect mind and memory, thanks being unto God calling unto mind the mortality of body and knowing that it is appointed for ... once to die, do make and ordain this my last Will and Testament: That is to say ... and first of all, I give and command my Soul unto the the hand of Almighty that gave it; and my body I recommend to the Earth, to be buried in a decent Christian burial, not doubting but at the general resurrection I shall revive the same by the power of God. And as touching such worldly Estate where with it has pleased God to bless me in this life. I give, devise, and dispose of the same in the following manner & form.
First I do hereby constitute make and ordain Daniel Davenport and Stephen Davenport my Brothers, on eof Plymouth township and the other of Huntington Township in the aforesaid County of Luzerne, the sole Executor of this my last Will and Testament,
Secondly I do give and bequeath unto Charles, George, Chester, Esther and Hendrick, the sons and daughter of my brother, Daniel Davenport and their heirs and assigns, forever, that piece of the Homestead Lot containing four acres and forty three perches, but the use of said four acres and forty three perches to my brother Daniel during his natural life. And I do give and bequeath unto my brother Daniel one and a half acres of the Garrison Lots, so called, and also that part of the Pitch number two, Containing five acres and sixty four perches. The last piece I sold to him some years past but not Deed to him, I give and bequeath to my Brother Daniel's five children and their heirs ans assigns forever, eight and a half acres of the Ayres Lot, but the use of the same to my Brother Daniel during his natural life, then to his five children and thier heirs.
Thirdly, I give and bequeath to my Brother Robert Davenport Five acres and a half, on the Allen Lot on the Flats, and all the interest that I have in the Currie Lands or money due to me from the heirs that took the Lnads, to him, his heirs and assigns forever, on his paying two hundred and fifty dollars within one year after my decease as I may direct hereafter.
Fourthly, I give and bequeath all the upper Lot in the Ten acre field, so called, Containing Six acres and Seventy Six perches to the Heirs of my sister Phebe Pringle, wife of John Pringle, the use of the said Six acres and Seventy six perches to my Sister Phebe during her natural life, in that way, that the use of the said tract of Land cannot be taken for any debt or demand of her said husband John Pringle, and at her decease, to the heirs of her body that may be to them and their heirs forever. Nevertheless I reserve all Coal that may be under the said parcel of Land, to be disposed of as I may Hereafter direct, also reserving a right of one acre if necessary for the purpose of mining the Coal but for no other purpose.
Fifthly, I give and bequeath all the middle partition of the Smith Lot, so called, Containing forty acres, to the heirs of my Brother Thomas Davenport, deceased, to them and their heirs forever.
Sixthly, I give and bequeath to my brother John Davenport, One hundred & Seventy Five Dollars, out of the money which will be due in one year after my decease from my Brother Robert Davenport, and the remainder Seventy five Dollars from my Brother Robert Davenport to my kind and esteemed Mother and my Aunt Phebe Pringle equally.
Seventhly, All notes and demands that I have against my Brother Daniel Davenport including Book accounts, I give and bequeath to my Mother, to be paid in furnishing her with Coal for the House use, if she should want the same, and that to be in full for said demands.
Eighthly, I do hereby authorise and require my Executors named in the first clause, Daniel & Stephen Davenport to sell and convey all the Coal that is under that tract of Land that I have given and bequeathed to the Heirs of my Sister Phebe Pringle to sell the same wit all the right I have reserved, for the best price od prices that can be obtained, as soon as circumstances wil admit or be expedited to so, and dispose of the ... not much short of Two thousand Dollars, and when the said Coal is sold I give and bequeath One hundred and fifty Dollars to my sister Elizabeth Van Loon ... and a like sum of one hundred and fifty Dollars unto my Sister Hannah Gould, wife of Jacob Gould to be paid to them and their heirs and assigns: And Three Hundred dollars to the Heirs of my Sister Phebe, after her natural death. -- the said Three hundred to ... remain in the hands of my Brother Stephen Davenport, The Interest of the Three Hundred Dollars to be paid to my Sister Phebe Pringle; and to no other person, for her sole use and after her decease, the three hundred to be paid by my Executor, Stephen Davenport to her Heirs of my Sister, Phebe Pringle, in one year.
Ninthly, I do give and bequeath to my Kind and esteemed Mother, all my personal property which I have not otherwise disposed of to her sole use, after paying all my lawful and just debts, and her paying ... Dollars to the Heirs of Thomas Davenport, deceased.
Tenthly: I do of my personal property require my Executors Daniel & Stephen Davenport, to have sufficient to pay all my debts, and to pay out of the same, Forty Dollars to the Heirs of my Brother Thomas Davenport , deceased, instead of my Mother having to do it. The residue of my personal property to my Mother.
Eleventhly: I do give and bequeath unto Daniel Davenport & Stephen Davenport my Executors, all the money that the Coal which is under that Tract of Sixty Six acres Seventy perches will sell for, after paying that Six hundred Dollars as is pointed and directed to be paid to my Sisters to be divided equally between them and their Heirs. -- And I do hereby revoke all former Wills, ratifying this to be my last Will & Testament.
In Witness whereof I have Hereunto set my hand and seal, this fifteenth day of ?ary, Eighteen hundred and thirty nine.
