I, James Waggener of the County of Jefferson and State of Kentucky, being low in body, but sound and disposing mind and memory do make and ordain this my hereby revoking all wills heretofore made by me.
In the first place I commit my soul into the hands of a merciful God who gave it and as to my estate I dispose, of it in the following manner Viz. Imprimis. I wish the property of which I die possessed both real and personal to be placed in the hands of my two brothers, Armstead Waggener and Reubin Waggener to be appropriated as Seemth best unto them for the benefit of my wife Elizabeth Waggener and her three children George, Mary and Elesif Waggeners And also for the payment of all my just debts:
In witness whereof I have hereto Set my hand and seal this 27th July 1822.

The within instrument of writing was produced in Court and proved to be the last will and testament of James Waggener deceased by the oath of William Lewis a subscribing witness thereto, and also on the 18th day of November 1822 the said instrument of writing was further and fully proven to be the last will and testament of the said James Waggener deceased by the oath of Ben W. Johnston the other Subscribing witness thereto and ordered to be recorded and is recorded in my Office as Clerk of said Court

This record was also from the Jefferson County, Kentucky Personal Property Tax List for 1811-1825. It is the same property and seems to confirm that James' brother Reuben acted as trustee of his estate after his death:

Crystal said that she couldn't read the 1824 record, and that there were no Waggeners/ Waggoners on the list in 1825.

James Waggoner estate. At September Court, 1825, Samuel Churchill, Harrison Arteburn, James W. Thornberry, William Meriweather and Jesse Swindler were appointed to divide and allot to Elizabeth Waggoner the widow of her dower of one-third of the plantation on which said James lived and died, on Salt River Road, and to divide the remainder between David B. Phillips and George C., Elizabeth and Elseff (Elesis?) Waggoner, children and infant heirs of James. Division of land, about 232 acres, was made December 7, 1825, allotting to the widow 72 acres, to the children 20 acres and balance to Phillips. Recorded January 4, 1826.

Elizabeth Waggoner; 1 male 10-14 years (George); 1 female under 5 (Ellisif?), 1 female 5-9 years (Mary?), 1 female 30-39 years (Elizabeth); 2 male slaves 10-23 years, 1 female slave 24-35 years
This confirms that after Elizabeth's husband James died, she had moved to Todd County by 1830. The enumerator must have erred in the entrys of Ellisif, who was 9 years old, and Mary, who was 11 years old.

From a series of transcribed family letters sent to my by Judy Senter, there is a letter written by Elizabeth (O'Neil) Waggener to her son George C. Waggener and his wife Mary Frances (Anderson). The letter is headed: "December 17th, Todd Co, near Trenton." It seems to have probably been written in 1838.
George and Mary had moved over a year earlier, from Todd County, Kentucky to near Carthage in Hancock County, Illinois, almost 400 miles away. Elizabeth had apparently sent the letter and received one from them, courtesy ofan apparent family friend "Mr. Thompson." Elizabeth gives motherly advice to George and Mary, and talks about concerns she has for their new home in Illinois.
Elizabeth speaks of her daughter Ellisif, who apparently lives close to her in Todd County, and is still unmarried at that time. She also comments on "Mr. Sims," the widower of her daughter Mary E. Waggener, who apparently died the previous year. They apparently also had lived near to Todd County.
Elizabeth comments that "Your grandma is here. I expect she will stay for some time.," but she doesn't mention if she's talking about her mother, or Elizabeth Garnett Waggener, the mother of her deceased husband.
Elizabeth talks about Stokely Towles Waggener and his wife Ann (Anderson) Waggener, who live nearby in Trenton, and run a store of some sort.

Notes for ELLISIF WAGGENER: From a series of transcribed family letters sent to my by Judy Senter: ****** There is a letter written by Ellisif's mother Elizabeth (O'Neil) Waggener to her brother George C. Waggener and his wife. They had moved from Todd County, Kentucky to Hancock County, Illinois in 1837.The letter is headed: "December 17th, Todd Co, near Trenton." It seems to have probably been written in 1838. Elizabeth writes of her daughter Ellisif, who is apparently living with or at least near her in Todd County, and in 1838 is not married. She does not mention how old she is at this point. She writes: "I have not seen Ellisif for neare too months She is below Hopkinsvil at James Joanses on a visithe is a cousin to the WaggenersI do not look for her much before Christmas ..... you said you heard her and Mr. Crafton was to be marriedthere is nothing of thatI do not no that either of them ever thought of the like he is lying very ill..." It is presumed that James Jones is a descendant of James Jones, father of Ann Jones who married James Herbert Waggener, and Ellisif's great grandmother. Apparently the Jones and Waggener families kept somewhat in touch for at least a few generations. Olive is apparently in either Tennessee or Kentucky, not far from Trenton, and the date is August 29, 1877. Olive speaks of a letter written by her father Stokely Towles Waggener to "Cousin Ell." It is clear that at that point, Ellisif was living somewhere near to the family of her brother George in Carthage, Illinois. ============ From the 1880 Federal Census of Carthage Township outside of Carthage, Hancock County, Illinois, district 64, page 7/ 45c, taken June 5, 1880, household 68; from ancestry.com, image 7 of 23. Ellesif is listed in the household of her husband: ------ Ellesif; female, age- 59, wife, married, occupation- keeping house, born- Kentucky, parents born- Virginia ========== There is another letter, sent to me by Judy Senter. It is written by Olive K. (Waggener) Waller in Austin, Texas, to her cousin Mary O. Waggener. It is dated only March 7, with no year. I believe it was probably written in the early 1890's. Olive asks, "How is cousin Ell getting on, and Mary and Lizzie and Tom Walker..." I believe that she is referring to Ellisif and that this indicates that she is still alive at this point. There are more letters, but none of the ones later than this mention Ellisif. I have not been able to find any other record or mention of Ellisif or her husband. I presume that they died in |
Notes for BENJAMIN GEORGE ANDERSON: From the 1850 Federal Census of Hancock, Illinois, taken August 20, 1850, household 70; from ancestry.com, image 10 of 358: Benjamin Anderson; age- 28, male, occupation- carpenter, real estate- $300, born- Kentucky Ellisif"; age- 28, female, born- Kentucky Luda"; age- 4, female, born- Kentucky I believe that Luda is actually Luda Walker, daughter of Eliza and Thomas Iverson Walker. Ellisif was a niece of Eliza Walker, making Luda a 1st cousin to her. Eliza and Thomas Walker had died in about 1847, in Todd County. Two of Luda's sisters, Mary and Elizabeth Walker, were living in the household of Ellisif's sister George C. Walker. George was also living in Hancock County in this census, in household 350.
