Became a Member of the Royal College of Surgeons in 1809. THIS IS THE LAST WILL AND TESTAMENT of me Thomas Colborne of Brentwood in the County of Essex Surgeon I give and bequeath unto my dear wife Harriet Colborne all and singular my household goods and furniture plate linen and china books prints and pictures trinkets and ornaments of the person wearing apparel and every thing else of a like sort or kind to and for her own absolute use and benefit I also give and bequeath to my said dear wife the sum of two hundred pounds for her own use and benefit I give and bequeath to each of my children the sum of ten pounds for Mourning and other Necessaries and in case any or either of my children shall be under the age of twenty one years at the time of my decease I direct that the said legacies bequeathed to each of my children respectively who shall be under the said age shall be paid to my said Wife In trust for her to apply the same at her entire discretion to each purpose and in such case I direct the receipt of my said Wife shall be a sufficient discharge for such respective legacies I give my friends Frederick William Lemon of Brentwood Essex and Richard Parker Lemon of the City of Bath all that my freehold messuage or tenement and premises with their appartenances being my dwelling house and premises situate at Brentwood aforesaid and also the several fixtures thereof To hold the same unto and to the use of them the said Harriet Colborne Frederick William Lemon and Richard Parker Lemon their heirs executors administrators and assigns Upon the several trusts nevertheless hereinafter mentioned and declared of and concerning the same that is to say upon trust to permit and suffer or sufficiently authorize and empower my said Wife Harriet Colborne to possess and enjoy the same or otherwise to have receive and take the rents issues and profits thereof as they shall respectively accrue due and become payable to and for her own absolute use and benefit during the term of her natural life she nevertheless thereout keeping the same premises in good and tenantable repair and well and sufficiently insured from loss or damage by fire and from and after the decease of my said Wife I direct my said Trustees or the Trustees or Trustee for the time being of this my Will do and shall sell and dispose of my said freehold messuage or tenement and premises and the several fixtures thereof either by public auction or private contract for the best price or prices that can be reasonably obtained for the same and do and shall convey and assure the same premises to the purchaser or purchasers thereof his or their heirs and assigns or as she he or they shall respectively direct or appoint and I direct that the receipt of the said trustees or the trustees or trustee for the time being of this my will shall be a sufficient discharge or a sufficient discharges for the monies to arise by the said sale or for so much thereof as in such receipt or receipts shall be acknowledged or expressed to be received and that the person or persons paying such monies shall not be answerable or accountable for any loss misapplication or nonapplication or be obliged or concerned to see to the application thereof and I do hereby declare that my said trustees or the trustees or trustee for the time being of this my Will shall and do by and out of the monies to arise and be produced by such sale or sales pay and satisfy all the costs charges and expenses attending or occasioned by the same sale or sales and shall and do stand possessed of and interested in the surplus of the monies to arise and be produced by such sale or sales Upon trust to add the same to the residue of my Personal Estate and Effects hereinafter mentioned and as to for and concerning. All and Singular the rest residue and remainder of my estate and effects whether real or personal that I or any person or persons in trust for me shall or may at the time of my decease be seized possessed of interested in or entitled unto or over which I shall or may have a divising or disposing power and not be me hereinbefore specifically devised or bequeathed I give devise and bequeath the same and every part and parcel thereof unto the said Harriet Colborne Frederick William Lemon and Richard Parker Lemon to hold the same unto and to the use of them the said Harriet Colborne Frederick William Lemon and Richard Parker Lemon their heirs executors administrators and assigns according to the several XXXXXX or quality thereof upon the trusts nevertheless and to and for the XXX intents and purposes hereinafter mentioned and declared of and concerning the same that is to say upon trust that they my said trustess or the survivors or survivor of them her or his heirs executors administrators and assigns do and shall with all convenient speed after my decease make sale and absolutely dispose of such part or parts of my said estate and effects as shall be in their nature saleable either by public auction or private contract as my said trustees shall think best and call in and convert into money all such other part or parts thereof and do and shall stand and be possessed of the monies to arise and be produced by the means aforesaid upon trust thereout to pay satisfy and discharge my just debts funeral testamentary and other expenses and after payment and full satisfaction thereof do and shall stand possessed of and interested in the residue of such monies upon trust to lay out and invest the same in or upon some or one of the Parliamentary stocks or public funds of Great Britain or at interest upon Government or real securities in England and from time to time to alter vary and transpose the same stocks funds and securities in or upon which the said trust monies shall have been so laid out or invested as my said Trustees or the trustees or trustee for the time being of this my will shall think fit or occasion require and I do hereby declare that they my said trustees or the trustees or trustee for the time being of this my will shall stand possessed of and interested in the said trust monies stocks funds and securities upon trust to pay and apply or otherwise sufficiently authorize and empower my said wife Harriet Colborne to have receive retain and take as the interest dividends and annual proceeds of the said trust monies stocks funds and securities as the same shall from time to time accrue due and become payable to and for her own sole separate and peculiar use and benefit independantly and exclusively of any husband with whom she may at any time hereafter intermarry his xxx xxxxxx or engagements and I direct that the receipt and receipts of my said wife alone whether covert or sole but not by way of anticipation shall be a good and sufficient discharge from time to time for the same and xxxx and after the decease of my said wife I do hereby declare that they my said trustees or the trustees or trustee for the time being shall stand possessed of and interested in the said trust monies stocks funds and securities and the interest dividends and annual produce thereof in trust for all and every my several children who shall be living at the time of my decease or born in due time afterwards (save and except only my son Thomas Colborne who being otherwise provided for I direct shall not participate in any portion of my estate and effects) to go and be paid and assigned and transferred to such children respectively except the said Thomas Colborne who shall then have attained or who may thereafter live to attain the age of twenty one years equally to be divided between and among them share and share alike as tenants in common and their respective executors administrators and assigns to and for their own absolute use and benefit and in case of the decease of any or either of my said children under the said age of twenty one years I direct that the share or shares respectively of such of them so dying as well original as accruing or surviving shall go to and or equally divided between and among the survivors or survivor of such children upon his her or their attaining the like age and if there should be but one such child then In trust for such one child his or her executors administrators and assigns to and for his her and their own use and benefit and to be paid assigned or transferred accordingly Provided always and I do hereby declare my will and mind to be that in case any of my said children shall be under the said age of twenty one years at the time of my said wifes decease it shall and maybe lawful to and for my said trustees or the trustee for the time being to pay and apply for and towards the maintenance and education use or benefit of such child or children respectively all or any part of the interest dividends and annual produce of the trust monies stocks funds and securities which such child or children respectively shall be for the time being entitled in expectancy under the trusts hereinbefore declared of and concerning the same also to advance or thereout raise any part not exceeding one hundred pounds of the trust monies stocks funds and securities to which such children respectively shall so for the time being be entitled in expectancy as aforesaid to be applied at the discretion of my trustees in for and towards the placing out in the world of such child or children respectively as an apprentice for or otherwise Provided always that during the lifetime of my said dear Wife her consent in writing be first had and obtained and in case there shall be at any time or times a suspense or vacancy of the person or persons for the time being entitled to a vested interest in the several trust monies stocks funds or securities under this my will or to the interest dividends or annual produce thereof then and in such case and so often as the same shall happen the interest dividends and annual produce of the said trust monies stocks funds and securities respectively or so much thereof respectively as shall so for the time being be suspended from vesting and not applied for maintenance and education use or benefit or advancement as aforesaid shall during such suspence as aforesaid be laid out and invested in the purchase or a competant share or competant shares of the public stocks or funds of Great Britain or at interest upon Government or real securities in England so that the same may accumulate and that the said last mentioned trust monies stocks funds and securities and the accumulations thereof respectively shall belong to and be in trust for such person or persons who under or by virtue of the trusts hereinbefore declared shall become entitled to a vested interest in the trust monies stocks funds and securities from the annual produce of which such accumulations shall have respectively proceeded I do hereby declare that the receipt or receipts of the trustees or trustee for the time being of this my will shall at all times be a sufficient discharge or sufficient discharges to any purchaser or purchasers of my said estate and effects or any other person or persons paying any monies for all such monies as in such receipt or receipts shall be acknowledged or expressed to be received and that the purchaser or purchasers person or persons paying such monies or money shall not after taking such receipt or receipts for the same as aforesaid be obliged to see to the application or be answerable for the loss misapplication or nonapplication of the same or any part thereof provided always and I do hereby declare that it shall and may be lawful to and for my said trustees or trustee for the time being of all or any of the messuages or tenements and hereditaments by me hereinbefore bequeathed to demise and lease the same messuages or tenements and hereditaments all or any part or parts thereof for any term or terms of years not exceeding twenty one years in possession for the best rent or rents that can be reasonably obtained for the same without taking any fine or foregift so that every such lease contain a condition for xxxxxxxx on nonpayment of the rent thereby reserved for the space of twenty one days next after the same shall become due and so that no leaser in any such lease be made dispunishable for xxxxxxx provided always and I do hereby declare and direct that if my said trustees or any or either of them or any future trustee or trustees to be appointed as hereinafter mentioned shall die or be desirous of being discharged of and from or refuse or decline or become incapable to act in the execution of the trusts hereby in them respectively reposed as aforesaid before the said trusts shall be fully performed then and in such case and when and as often as the same shall happen it shall xxxxxxxxxx be lawful to and for the continuing or surviving trustee or the executors or administrators of the last deceased trustee for the time being by writing under his her or their hand or hands from time to time to nominate and appoint any other person or persons to be a trustee or trustees in the place or stead of the trustee or trustees so dying or desiring to be discharged or refusing declining or becoming incapable to act as aforesaid and thereupon all and singular the said trust monies and premises shall be conveyed and assigned unto and be vested in the new trustee or trustees either jointly with the surviving and now trustee or in such new trustees only as occasion shall require to for and upon such and the same trusts intents and purposes as are hereinbefore expressed and declared of and concerning the same or such of them as shall be then subsisting or capable of taking effect and that every such new trustee or trustees shall and may in all things act in the execution of the said trusts as fully and effectually to all intents and purposes as if he she or they had been originally in and by this my will nominated a trustee or trustees hereof and I do hereby expressly direct that any persons acting as a trustee under this mt will shall not be answerable or accountable for any more money than what they he or she shall respectively actually receive or that shall come to their her or his hands or hand virtue of this my will the joining in receipts for conformity notwithstanding nor for any loss which may happen in or to the said trust monies and premises without her or his wilful neglect or default respectively nor either of my said trustees for the other of them or for the acts deeds or defaults of the other of them and that every such trustee shall and may retain to and reimburse herself himself and allow to her or his cotrustees out of the said trust monies which shall come to their her or his hands or hand all such costs charges and expenses as they or either of them shall respectively pay sustain or be put unto by reason or means of this my will or in or about the execution of any of the trusts hereby in them respectively reposed and I give devise and bequeath all the estates vested in me on any trusts or by way of mortgage and which I have power to dispose of by this my will with their appurtenances unto and to the use of the said Harriet Colborne Frederick William Lemon and Richard Parker Lemon their heirs executors administrators and assigns according to the several natures and quality thereof respectively upon the several trusts affecting the same and I nominate constitute and appoint my said wife Harriet Colborne Frederick William Lemon and Richard Parker Lemon Executors of this my will and Guardians of my children during their minority respectively and I give and bequeath to the said Frederick William Lemon and Richard Parker Lemon the sum of nineteen pounds and nineteen shillings each as a small renumeration for the trouble they may have in performing the several trusts of this my will hereby revoking and making void all former wills I declare this paper writing to be and contain my last will and testament in witness whereof I have to the five previous sheets and to this sixth and last sheet set my hand this eighteenth day of May one
