THOMAS HAM'S LAST WILL & TESTAMENT
Amelia Co, VA 1780-1786 Will Book 3, pages 121-122
The Court held for Amelia County Oct. 25th 1781. This Will was proved by
the Oath of Edward Jones one of the Witnesses thereto and at another Court
held for the said County June 27, 1782 the same was proven by the Oath of
Joseph Royall another witness thereto and ordered to be recorded and on the
Motion of Phobe Belcher the Executrix therein named who took the Oath and
gave Bond with Security according to Law. Certificate was granted her for
obtaing a probate in due form.

In the Name of God Amen I Thomas Ham of the County of Amelia Being Sick and
weak but of Sound mind and Memory do make this my last Will & Testament.
Item my Will and desire is that my two Sons Thomas and Obediah Ham be put
to School Four years each at -- expence of my estate.
Item I leave to my beloved Wife Sarah the use and possession of all my
Estate real & Personal so long as she continues my Widow to enable her to
Educate and bring up my Children. But incase my Wife again Marrys then my
Will is that my estate be divided & that my Wife receive such part thereof
as by Law she would be entitled to if I had dy'd witout will.
Item I give my Land to be equally divided between my Sons, Thomas and
Obediah Ham, And all the rest of my Estate I give to be equally divided
among all my five Children Oney Self, Polly, Betsy, Thomas and Obediah Ham,
or their legal representitives to them and their Heirs forever. But in
Such division it is my desire that my two Sons shou'd have the two Negros I
possess nam'd Sam, & Daniel, and that my Daughters each receive as much of
my Personal estate as will make their parts equal with the Value of their
Negros that I give my Sons. And at my wifes decease I desire that the part
that may be alotted her incase she again Marrys may be equally divided
among all my Children then living & their legal representatives-
Lastly I appoint my beloved wife Sarah & William Hurt & Christopher Ford
Executors of this my last Will & Testament revoking all former Wills by me
made----

Oath and gave Bond with Security as the Law directs Certificate was granted
her for obtaining a probate in due form.
