      27 March 1762

      William Comer, eldest son and heir at law of John Comer, late of King William County, deceased, and of full age, of the one part, and William Chandler, for and on behalf of Elizabeth Comer, one of the daughters of the said John Comer, who by free will has made choice of as her guardian in the county of Lunenburg, and Samuel Comer, who was by the court appointed guardian of Daniel, Samuel and Annis Comer, other children of the said John Comer and infants under the age appointed by law to make choice of their guardian, of the other part.

      William for Samuel Comer yielding possission o the tract of land where Annis Carrol, widow and relect of said John Comer, now resides in the county of Lunenburg, to hold for the term of one whole year from the time that the said Annis shall marry again or quit possession of same to the end thereof at which time said William Covenants to yield back to said Samuel the quiet possession of said tract. William doth further covenant that said William Chandler and Samuel Comer for and in behalf of the parties infant as aforsaid that he will at the expiration of the year aforementioned plantation is situated, into 4 equal parts of divisions according to the will and desire of his late father John Comer: 1/4 part of which the said Samuel doth agree to convey to the said William; 1/4 part to Daniel, the said John's brother [sic]; in fee simple; provision that the siad three parts to brothers will be vested in their sisters Elizabeth and Annis if brothers die without issue of their bodies or underage.

      William Comer further agrees that William Chandler and Samuel Comer, for and in behalf of said John Comer, his father, take his equal part and share thereof of such division as shall be made by parties or their guardians or by such other persons as the court shall appoint without molestation.

      William Comer binds himself under penalty of 500 pound current money of Virginia, to be recovered by said William Chandler and Samuel Comer or either of them on behalf of the children to whom they are appointed as guardians.

JOHN COMER, Jr.(John Sr.) d. 1757, m. Annis, Annie, Anna Carroll who married (2) William Sammond. The date of death is established in a court order found in the Lunenberg County Order Book 5, p. 27 . It reads:

December Court 1757 - Ordered that the Church wardens of Cumberland
Parish, Lunenberg County do bind out WILLIAM COMER, orphan of John
Comer, deceased, to JOSEPH SHIP.

Note: Joseph Shipp was a surveyer.

The estate of John Comer Jr. was settled in 1762, five years later, and this date has been mistakenly cited as the date of his death. Anna Sammond is clearly referred to as his widow and his children are listed. The document reads:

1762 Dec. 9th. A Division of the Estate of John Comer Dec'd and Anna Sammonds,Wid. of the Dec'd. ,William Comer, Elizabeth Lucus, Daniel Comer, Samuel Comer and Annis Comer Heirs of the Dec'd. Wm. and Annis Sammond.......Rec. of the Dec'd. the Purportion (sic).......

11 Dec. 1762, the court examined the settlement and on 12 April 1764 the division was returned and recorded.

Note: William had been apprenticed out in 1757 and so must have been at least 17 at the time. Elizabeth was able to choose her own guardian (William Chandler, who was a surveyor, relationship ?) and so must have been at least 14. The three younger children - Daniel, Samuel, and Annis - were left to the guardianship of their uncle, Samuel Comer, the brother of John Comer Jr. Articles of Agreement were signed in Lunenburg co., 22 March 1762, recorded 6 April 1762, dealing with the distribution of John Comer Jr.'s lands. In the agreement, his widow was referred to as Annis Carrol, so she evidently married William Sammond between March and December of 1762. In 1765, Samuel Comer transferred to Annis Comer 220 acres, which was her share of her father's lands as per the agreement and to Samuel, 180 acres.

(Lun. DB7/210) Articles of agreement between William Comer, eldest son & heir at law to John Comer late of the County of King William dec'd and of full age of one part, and William Chandler for and in behalf of Elizabeth Comer one of the daughters of the said John Comer who, by her own free will has made choice of (Chandler) as her guardian in L Court, and Samuel Comer who was by the same court appointed guardian to Daniel, Samuel, and Anne Comer, other children of the said John, and legal infants, appointed by law to make choice of their guardian of the other part. William, for and in consideration of the said Samuel yeilding him the possession of the tract
of land and plantation whereon Annis Carrol, widow and relict of the said John now lives in L, to hold for him for the term of 1 year from the time that the said Annis shall again marry or quit possession of the same, at which time William agrees to yield back to the said Samuel the possession of the said tract of land and plantation. At the end of 1 year, William agrees to the laying off 1000 acres off the aforementioned plantation into 4 equal parts according to the will of his late father, John Comer. One fourth part, Samuel agrees to convey to William. Another fourth goes to Daniel Comer, and the other fourth goes to Samuel Comer. If one of the brothers dies without heirs, the land is to be vested in their sisters, Elizabeth and Annis, to be equally divided between them. William agrees to divide the Negroes and personal estate of John Comer, his father. William binds himself in the penal sum of 500 pounds to insure the faithful performance of these articles. Notes/proof re parents of ANNIS COMER DAVENPORT: ANNIS COMER and her husband BEDFORD DAVENPORT were part of a litigation in 1797 over the estate of JAMES MOSS of New Kent county who died without heir and who was the brother of ELIZABETH MOSS COMER. They granted "power of attorney to brother MOSS COMER to collect our portion of the estate of James Moss decd. of New Kent." ( Recorded DB17/137) Had Annis not been the daughter of Samuel and Elizabeth Moss Comer she would have had no claim on the estate of James Moss. The children of John Comer Jr. could not have claimed to be heirs. All of Samuel and Elizabeth Moss Comer's children were claimants to the estate of James Moss, with Hugh Moss Comer handling the litigation for them all, Rebecca and William Clay in E. TN, and James and Anderson Comer in GA included.. Contrary to Walker, all of the females named by Samuel Comer in his will as his 'daughters', including one she omitted to list, were, indeed, his daughters.

HOMAS COMER:
Thomas Comer did not figure in the distribution of the slaves of John Comer Sr. although, as a son, he had been a party to the court suit. Why? Had he died in the interim or could he be the Thomas Comer who married Frances? Thomas Comer below died bet. Oct. 1793 and
Jan. 1794, Halifax County, Virginia, Will Book 3, 1792-1797, p. 94. He is found in various land transactions in Halifax County, some of which state that Frances, his wife, relinquishes her dowry, as in a sale of four hundred acres to John Clardy by Thomas Comer (Comar), planter, Halifax DB, 19 Sep. 1776. His will names his son John Comer, son-in-law Andrew Torain, and wife as executors. Note that the son is referred to as John C. Comer. The material on the Thomas Comer family has been collected by Linda Hutchins Collier and beautifully referenced.
