He married ELIZABETH MOSS Abt. 1745, daughter of JAMES MOSS and REBECCA KING. She was born 1730 in New Kent County, Virginia, and died 1790 in Charlotte County, Virginia.

He was baptised in Saint Peter's Church in New Kent County, Virginia in 1730. After the death of his brother, John C. She is mentioned in the will of her mother, REBECCA MOSS , signed 1 Feb. 1770, Goochland co, VA. Elizabeth Comer's will is recorded in Charlotte co. Wills, 1765-1791. p. 426a, 27 Oct. 1789, WP 1 Feb. 1790, that leaves her estate to her daughter, Nancy. Jacob Morton, Gent. was named executor, and witnesses were Josiah Legrand, who was Nancy Comer's guardian, and George Cardwell.

The Walker book says that of the five"daughters" named in the will of SAMMUEL COMER, only Rebecca is a true daughter while the others
are nieces,the daughters of Samuel's brother, John Comer Jr. As proof, she cites the court decision which made Samuel Comer guardian of John Comer Jr.'s minor children. Their names were Daniel, Samuel, and Annie Comer, only one of whom was female. Annie had a sister, Elizabeth who married John Lucus so John Comer Jr. had two daughters only: Annie Comer and Elizabeth Comer. Samuel Comer's daughters, five in number according to his will, were: Mary Comer LeGrand, Sally Comer Lucus, Rebecca Comer, Annie Comer Davenport, and Nancy Comer whom Walker completely omitted from the copy of the will included in her book. The will, written on 4 February 1788 and proved on 22 December 1788 in Halifax co., VA reads in part:

"I give and bequeath to my son James Comer...........unto my son Anderson Comer.........unto my daughter Mary LeGrand..........unto my daughter Sally Lucus.......unto my daughter Nancy Comer........unto my son Hugh Moss Comer......unto my daughter Rebecca Comer... (and) ..unto my daughter Annis Davenport the remainder part of all I possess....."

Major Thomas Davenport and Bedford Davenport were chosen as executors. Witnesses were Will McCraw Jr., John Woodson, James McCraw Jr., Samuel McCraw, James Kent, Joseph Holt, and Robert Easly. Sec. Joseph Holt, Robert Easly.

It seems unlikely that Samuel Comer would have left the bulk of his estate to someone Walker calls a niece, particularly in view of the fact
that in 1765 he had already given his niece, Annie Comer, orphan of John Comer Jr., 220 acres, her share of her father's lands. Also, in the Charlotte Co. Guardian Accounts 1782-1789, p. 113, Aug, 1792, is an item which reads in part: .....

"John Bassett and my now wife Nancy Comer, orphan of Samuel Comer, guardian, Josiah Legrand......" and from the Charlotte Order Book 9 (1792-1794):

"Josiah LeGrand, guardian to Nancy Comer, orphan of Samuel Comer, produced receipt of John Bassett who has intermarried with Nancy"
Too, Annis Comer Davenport and her husband Bedford Davenport were part of a litigation in 1797 over the estate of James Moss of New Kent county who died without heir and who was the brother of Elizabeth Moss Comer. They granted "power of attorney to brother Moss Comer to collect our portion of the estate of James Moss decd. of New Kent." ( Recorded DB17/137) Had Annis not been the daughter of Elizabeth Moss Comer she would have had no claim on the estate. In addition to Annis and Bedford Davenport, Rebecca Comer
and William Clay in TN, and James Comer and Anderson Comer in Georgia gave power of attorney to Hugh Moss Comer to collect their portions of the estate. There seems no credible reason to believe that the persons Samuel called "daughters" in his will were not, in fact, his daughters. Annis Davenport (wife of Bedford Davenport); Mary LeGrand, ( wife of William LeGrand); Sally Lucus (wife of Moses Lucus); Nancy, later Bassett; and Rebecca, later Clay, were undoubtedly sisters. Neither names nor numbers fit with their being the daughters of John Comer Jr. whose daughters numbered but two and whose names were Elizabeth Lucus, wife of John Lucus; and Annie Comer.

In his will proved 16 Sep. 1793, Prince Edward co., witnessed by John Baldwin, Robert emancipated his personal servant and named as legatees his surviving children Samuel Peek, John Comer Peek, Henry Peek, Charles Peek, Agnes Penick and Charles, Jane Lewis and Thomas, and Susannah Baldwin and John.
