Deed of Land
George Smith THIS INDENTURE made the 25th day of May in the year of our Lord
To // Deed one thousand eight hundred and eighteen between George Smith of
Samuel Binnegar Frederick County and State of Virginia of the one part and Samuel
Binneger of the County of Harrison and State aforesaid of the other
part.
WITNESSETH that the said George Smith for and in consideration of the sum of three hundred dollars Current Money of Virginia unto him in hand paid by the said Samuel Binnegar at or before the sealing and delivery hereof the receipt whereof I do hereby acknowledge and thereof do release acquit and discharge the said Samuel Binnegar his heirs executors and administrators by these presents the said George Smith hath granted sold aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien enfeoff and confirm unto the said Samuel Binnegar his heirs and assigns forever a certain tract of land lying & being in the County of Harrison on the North side of Simpsons Creek being part of a survey granted to Samuel Smith by patent and bounded as followeth (Towit) Beginning at a white oak beginning corner to the original survey and with said original line S 72 poles to a beech on the bank of the Creek thence up the Creek with the meanders thereof 149 poles to a pow pow on the bank thence North ½ Deg. East 70 poles to a water beech S 89 ½ Deg. East 10 poles to a Realoak North ½ Deg. East 4 poles to a stake thence North 89 ½ Deg. West 10 poles to a Gum thence North ½ Deg. East 126 poles to a stake on the original line and with same South 58 Deg. West 131 poles to the Beginning containing Ninety eight acres be the same more or less togither with all and singular the rights Improvements Hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and Reversions and Remainders Rents Issues and Profits thereof. Also all the Estate Right Title Interest Use Property Claim and Demand whatsoever of him the Said George Smith in Law or equity of and in the premises aforesaid and every part thereof To Have and To Hold all and singular the premises with the appurtenances hereby granted unto the said Samuel Binnegar his heirs and assigns to the only proper use and behoof of the said Samuel Binnegar his heirs and assigns forever. And the said George Smith do hereby covenant for himself and his heirs that he is seized of good and indefasible estate of inheritance in the premises and that he hath good right to convey the same to the said Samuel Binnegar in manner aforesaid. And Lastly that the said George Smith and his heirs all and singular the premises hereby granted with their appurtenances unto the said Samuel Binnegar his heirs and assigns against the said George Smith and his heirs and all and every other person or persons shall warrant and forever defend by these presents.

We John Davisson and Notley Shettlesworth Justices of the peace for said County do hereby certify George Smith who is party to the within conveyance bearing date the 25 day of May 1818 doth acknowledge the same before us and directed us to certify the said acknowledgement to the Clerk of the County Court of Harrison in order that the said acknowledgement and conveyance may be recorded.

Samuel Binnegar, my 4th great grandfather was the husband of
Judith Smith, my 4th great-grandmother. She was the daughter of Andrew Smith and a niece to George Smith.
