Between 1796-1799 James Scruggs, Thomas’ son-in-law & Executor of his estate sued the Estate of Obediah Daniel’s in the amount of £153,,7,,2 ¾ for a deed of conveyance in 1774 made between Thomas Poor & Obediah Daniels. The deed was for five slaves that Thomas “sold” Obediah, but that Obediah failed to pay. The Chancery Court determined in 1799 that the slaves were lent to Obediah and that the deed was made between the parties for the purpose of Obediah or his heirs to be indemnified of future payment to Thomas. The documents for this court case are not whole and are difficult to read and understand. Below is the “Answer” of Obediah’s Executors to the “Bill” filed by James Scruggs and the “Decree” issued by the Court of Chancery.
“Answer” of John & Ichabod Daniel, Executors of Obediah Daniel’s Estate:
“The Joint Answers of John John(sic) and Icabod Daniel Excrs of Obadiah Daniel Decd to a Bill in Chauncery exhibited against them in the County Court of Goochland by James Scruggs Excr of Thomas
Poor Decd Compt – These Defdts for answer to the said Bill say that true it is they believe that their Testator in his life time did execute the Deed of conveyance in the Bill mentioned, but from the best
in= formation they Can obtain they are convinced that it never was intend- ed by the parties to operate as an absolute transfer of the Right of their Testator to said Poor but only as a Security against
his suffering on account of his having about that time been Security for their Testator on a three month Replisic[??] Bone to Henderson, McCaid. & Co. or George Kippen & Co. (all of whom these Defdts
believe are connect in Trade). These Defdts believe that this was the only consideration, or purpose for which the said Deed was executed, that the said Poor never advanced a Single farthing for the property therein mentioned and these Defdts think they shall have it in their power to prove that the said Poor acknowledged and confessed the same some short time before his Death – The confess that they do believe there yet remains a Considerable sum due to the said Companies to pay which they are now making provision but they cannot asurtain(sic) the amount, having Vouchers to only to establish the paiment(sic) of £54,,5.5 which they do not con= ceive to be all the Credits to which they are intitled(sic). That the Negroe(sic) Tom in the Deed Mentioned was sold at public Sale in the life time of these Defdts Testator for the benefit of said McCaid & Co. in the presence of said Poor for £45:10: which is a part of the £54:5:5 above mentioned as to the Remainder of the Slaves; This Defdt Icabod has in his possession James, Mary, and Cate, and also Candasa Daughter of Cate about 5 or 6 years old = also Judy about 21. and Betty about 18 years of age bothe Daughters of Rachael-, and the Defdt John has in his possession one of the Slaves in the Deed Mentioned (named Rachael 55 years old he has also had another another which he has since sold name Morning now about 12 years old a Daughter of Cate – and Barton a son of Cate now 9 years of age upon a Division of the Estate fell to Mosely Daniel who has since sold him – That is has now been about 20 years times Since these Defdts and the rest of their Testators Le- gatees have been in peaceable possession of the Slaves in said Deed mentioned. that nearly half that time the said Poor lived a near Neigh bour(sic) to them and never demanded the said Slaves or any hire for them from which circumstances these Defdts conceive that the Act of Limita on(sic) will apply and which they do hereby Plead and rely upon as fully as it had been Specially pleaded separate and apart from this their an= swer = These Defdts pray that they may be quilted in their possession of their Said Slaves & be hence dismissed with their(sic) Costs et al –
